Based on the 1905 Jacobson v. Massachusetts Supreme Court case -- states already have the authority to mandate vaccinations. Likewise states -- via court decisions -- have the power to mandate public health measures.
Like I said it seems the individual “State” can set it’s own health policy. The courts have backed state decisions but when states balk at Federal Mandates the court is sympathetic and steps in with an injunction. Which is the way it should be. Biden’s EO’s and current OSHA regulations are dead on arrival at court.
Actually the U.S. Supreme Court is very likely to support the federal vaccine mandates and OSHA regulations based on previous cases according to most people who closely follow the U.S. Supreme Court. I didn’t read to decision, just my limited observation the courts have backed the states regardless of which way they’ve leaned.
And I’d expect you to say exactly that. The Circuit Courts have tossed the federal mandates out the window, I’d say SCOTUS, if they take it, will rule the same. Keep dreaming.
Circuit Courts have not tossed vaccine mandates out the window. All of these vaccine mandate cases must be routed to the 6th Circuit Court which has not ruled on any of them yet. The actions of a few Trump appointed judges is next to meaningless -- just short term bumps in the road.
