  1. This should be quite an interesting legal case. First and foremost the issue will be moot by the time the case reaches any other court because the federal court already rejected it. If you have no health reasons to not get the shot and the hospital requires it for employment, the hospital does have some leeway since they can make a strong legal argument based on health and safety and the employee will only make some general sweeping freedom/right argument with nothing cooncrete to support their case. For that reason I don't see the 5th Circuit maybe touching this....

    99% of the people got vaccinated so that 1% really has a weak case considering that people allergic to the shot were exempt. People claiming religious reasons is just a bunch of bullshit since Thou Shall Not Take Vaccines was never in the holy scripture haha...

    A mere 153 employees refused to get the COVID vaccine out of over 25,000 employees. This means a minimum of 99.4% of the employees agreed to take the vaccine.

    This case will be thrown out of court. The federal government and the court system has already determined that employers can require employees to be vaccinated.

    San Francisco’s 35,000-strong city workforce have been told they must get vaccinated against Covid and if they don’t – could face getting sacked.

    The new policy was announced by officials in the Californian city on Wednesday, and makes it the first city in the US to demand all of its government workers be fully-vaccinated.

    Exemptions will be granted for medical or religious reasons but workers without exemptions who still refuse to get vaccinated could be fired.

    Mawuli Tugbenyoh, chief of policy for the city’s Department of Human Resources, said repercussions for those who refuse their vaccines ‘go all the way up to termination’.

    San Francisco city bosses had previously said they will require employees to be vaccinated in high-risk settings, including hospitals, nursing homes and jails, regardless of whether they work for the city.

    The new policy will vaccinations a requirement for workers’ employment and will include police officers, firefighters, bus and train operators, City Hall clerks and custodians. The mandate will not cover teachers, however, who are school district employees, according to the San Francisco Chronicle

    More than 150 staff members at a hospital in Houston, Texas, were fired or resigned for refusing to get a Covid vaccine. Houston Methodist Hospital system, which runs almost 300 healthcare sites in the city, had ordered its 25,000-strong workforce to get vaccinated by June 21 or face being fired.

    Employees in San Francisco will have ten weeks after a vaccine is approved by the FDA to get their shots. The three vaccines that are being used in the US currently have been given emergency authorization by the FDA, and are expected to be fully approved within a few months.

    Starting on Monday, employees will have 30 days to tell their bosses what their current vaccination status and will have to show proof of vaccination.

    As of Wednesday, about 55% of city employees are believed to be at least partially vaccinated, according to the Department of Human Resources. A further 5% of employees have said they are not vaccinated while the vaccination status of the remaining 40% is not known.

    Carol Isen, San Francisco director of human resources, said: ‘It’s really a decision for the health and safety of our employees and our public that we serve.

    ‘It’s about protecting the city as an employer from what we deem to be unacceptable risk.’

    For several months, employers have focused on encouraging, but not requiring, Covid-19 vaccinations. Experts say many are now giving mandates another look, thanks to several recent developments.

    Earlier this spring, as Covid-19 vaccine access expanded rapidly across the nation, most employers weren't choosing to require workers to receive the vaccine.

    A February survey by global employment law firm Littler Mendelson PC found less than 1% of employers were requiring Covid-19 vaccinations for all workers — although another 6% planned to take that step in the future. While experts say there’s nothing in federal law prohibiting a vaccine mandate for private employers, many companies concluded it wasn’t worth the headaches.

    But there are signs those sentiments may be changing.

    Employment law attorneys say more businesses are now seriously considering vaccine mandates than they were three months ago, and they anticipate the number of employers implementing a mandate will climb in the months to come, with health care providers likely to lead the way.

    Several factors are contributing to the shift, including recent guidance from the Occupational Health and Safety Administration and a federal court's dismissal of a Texas lawsuit by employees of Houston Methodist Hospital, who were suing the hospital over its Covid-19 vaccine requirement.

    Steven W. Suflas, a Salt Lake City-based senior counsel at Ballard Spahr LLP law firm, said the court decision has made employers more comfortable with the idea of a vaccine mandate, and it's one of several factors that has companies taking a closer look at mandates.

    “They are thinking about it harder, and I think we will see people moving to [mandates],” Suflas said.

    Prior to that decision, many employment law experts had said some employers had been wary of mandating a vaccine under emergency use authorization from the Food and Drug Administration, in part because of a lack of court precedent and unclear federal guidance. That was leading companies to focus their efforts on encouraging vaccinations through incentives and education efforts.

    Suflas said a full approval of vaccines from the FDA would likely be another milestone leading to more mandates.

    Meghan McCaig, a Dallas-based partner at Thompson & Knight LLP law firm, has also noticed more employers are considering a mandate as the situation evolves.

    While OSHA's long-awaited guidance didn't focus on vaccine mandates, McCaig said it highlighted the benefits of having a fully vaccinated workforce by saying fully vaccinated employees can resume activities without masks or social distancing, unless required by state or local laws.

    Experts say that could further encourage employers to pursue a mandate when they believe it's possible to reach a 100% vaccination rate. Many of OSHA's recommendations on Covid-19, particularly those around masks, wouldn't apply to a company with a fully vaccinated staff.

    For employers looking to implement a mandate, experts offer a few tips.

    McCaig said employers must ensure sure they are taking the Americans with Disabilities Act and the Equal Employment Opportunity Commission guidelines into account for employees with a medical or religious reason for refusing the vaccine. Companies also need to be aware of state or local laws that may prohibit mandates or even asking about vaccination status.

    Suflas said it's critical to know what you’ll be getting into if you opt to require the vaccine.

    “You’ve got to have a finger on the pulse of your workforce,” Suflas said. “You’ve got to be constantly analyzing the possible response.”

    The Covid-19 vaccine is a political lightning rod within many companies, so experts say employers need to keep that in mind and consider the impact of a mandate on morale, retention and recruitment.

    Some employment law experts have toldThe Business Journals they’ve had to tread carefully with vaccine policy for fear of turnover or worries about attracting workers in the intense labor market.

    Beyond anticipating the response, Suflas said it’s important for companies to justify their mandates and communicate that information to employees.

    “From a human resources perspective, the better an employer can justify it and can tie the vaccine mandate to the business — to come up with a business case as to why it’s important — the stronger position they’ll be in,” Suflas said.

    Producers & Actors Urged SAG-AFTRA To Adopt Guidelines For Employers Who Want To Make Covid-19 Vaccinations Mandatory

    A chorus of calls for mandatory Covid-19 vaccinations – and the possibility that the industry soon might make them a requirement – prompted SAG-AFTRA to adopt new guidelines for employers who want to require proof of vaccination as a condition of employment. To date, vaccinations of casts and crews are not mandatory on film and TV productions under the industry’s return-to-work protocols. But those protocols expire on Wednesday and are being renegotiated by the major companies and Hollywood’s unions.

    On Thursday, SAG-AFTRA’s national board of directors approved a motion that authorizes the union’s staff “to approve requests for mandatory vaccination policies in strict compliance with SAG-AFTRA’s standard parameters for mandatory vaccination policies.”

    During the board meeting, SAG-AFTRA leaders presented letters from producers and members that urged the union to adopt policies that would allow producers to mandate vaccinations. SAG-AFTRA leaders noted that that they’d received such requests from producers on shows airing on HBO, Starz and MRC and from the Producers Guild of America, as well.

    The reasons for the requests, SAG-AFTRA leaders told the board, include:
    • Accommodating cast and crew requests
    • Simplifying response to potential Covid exposures
    • Future modifications to Covid protocols
    • And for independent producers, access to insurance coverage
    “I am writing to you in support of HBO’s request to mandate vaccinations for all cast and crew on season 3″ of the show, the creator and star of an HBO series said in a letter addressed to SAG-AFTRA national executive director Duncan Crabtree-Ireland, to the SAG-AFTRA President’s Blue Ribbon Commission on Safety and cc’d to an HBO labor relations executive. “Mandating that the cast and crew are vaccinated is the only way for us to minimize risk on this production. All of our series regulars have been vaccinated. In addition, all of our department heads and crew members working with us as of today have been vaccinated. I am 100% in favor of HBO’s request for union support of mandating vaccinations on (the show). This is the safest way to move our production forward.”

    SAG-AFTRA removed the names and other identifiers of those whose letters were presented to the board.

    In an email to SAG-AFTRA president Gabrielle Carteris, an 18-year member of the union wrote “to express my support for vaccine protocols being implemented by our union and to state that I agree that vaccination status should absolutely play a role in hiring. It’s not fair to anyone/everyone who has weathered this pandemic storm and avoided Covid-19 infection to be unknowingly sharing space and doing scene work with individuals who, for whatever reason, have not been vaccinated. I have an 8-year-old son who is unable to be vaccinated and I would be devastated and extremely upset to discover I brought the virus home to my child because of an interaction at work with another actor or crew member who wasn’t vaccinated. I understand everyone has their right to privacy with regards to their vaccination status, but in my opinion, those rights should not infringe upon my rights to work in a safe and healthy environment. I would hope my union would agree.”

    Another actor wrote: “I wanted to add my name to the list of members advocating a vaccine requirement for performers reentering productions. The choice to opt out of vaccines is a personal one, but it shouldn’t trump the safety of those who have made the choice to follow protocols that both the CDC and the medical community as a whole have said are safe and effective in reducing the risks of this deadly virus. I hope the Guild will advocate strict guidelines regarding protections for our members, most of whom have to perform their duties minus any protections mandated for all other departments.”

    Another actor told Carteris: “I am in full agreement that every actor and crew member should have the vaccination for Covid-19 when they are on the set, I come to you on bended knee with this plea. We’ve lost so many, and we want our sets to be as safe as possible.”

    Yet another actor told the SAG-AFTRA president: “I’ve been very concerned with the safety of our work environments during Covid. Now that the vaccine is available to anyone who wants it, I find it hard to understand why people who refuse the vaccine – other than those rare cases of a legitimate medical reason – are entitled to work on crowded stages or locations with the rest of us, including playing scenes in which we are screaming in each other’s faces, as I recently did with an actor who, it turns out, is not vaccinated. Personal freedom is one thing. I don’t understand the argument by a small minority that their ‘personal freedom’ includes the right to endanger everyone around them by working while unmasked – by necessity – AND unvaccinated – by choice. I strongly believe vaccination status should be a factor in hiring actors, and producers should make the vaccine available when necessary. Virtually every actor I’ve discussed this with in the past few months has agreed wholeheartedly. I’ve heard one exception.”

    Even so, 25% of the SAG-AFTRA board voted against adopting the new guidelines. Contacted by Deadline, a dissident board member said that “everyone should have the right to choose what they do with their own bodies” and that the new guidelines leave SAG-AFTRA vulnerable to potential lawsuits. “If a producer says the entire cast needs to be vaccinated, that discriminates against any actor who either has a medical or religious exemption, or just chooses not to take it. The Health Insurance Portability and Accountability Act (HIPAA) says that no one is allowed to ask you about your medical information. How would you like it if someone asked you if you had AIDS when you went on an audition, and the union said that that was okay?”

    The dissident also argues that mandating the taking of “experimental medicines that have not been approved by the FDA is a violation of the U.S. Constitution, the 14th Amendment and the Nuremberg Codes.”

    SAG-AFTRA’s new guidelines on employers’ mandatory vaccination policies stipulate that:

    1. Production must announce such policies as soon as possible, preferably in initial breakdowns or earliest casting discussions.
    2. Such policies must apply equally to all cast and crew working in the relevant zone(s) or work location(s).
    3. Production must have procedures in place to engage in interactive process with those requesting ADA (Americans with Disability Act) or religious accommodations, and must include the procedure for initiating a request in notices of the vaccination policy.
    4. Such policies can only be enforced when vaccines have been readily available to performers for a sufficient period of time to confer immunity in time for start of work.
    5. If being vaccinated as a condition of employment for the production, any vaccination costs are absorbed by employer and vaccination time is work time.
    6. Vaccination records are maintained securely by employers and available only to those with need to know.

    An Ohio judge will require some criminals to get a coronavirus vaccination as a condition of probation, local reports said.

    “It occurred to me that at least some of these folks need to be encouraged not to procrastinate,” Richard Frye, a judge in Franklin County, told the Columbus Dispatch.

    One order posted by the newspaper shows a man was required to share proof of vaccination with the probation department within 30 days to assist with “his ability to gain employment.”

    “I think it’s a reasonable condition when we’re telling people to get employed and be out in the community,” Frye said.

    The judge said he’s only ordered three people to get jabbed out of 20 who came before him for sentencing last week, according to the report. None of the three expressed religious or medical or religious opposition, the judge said – but at least one of the probationers isn’t happy.

    Sylvaun Latham, reportedly convicted on weapons and drug charges, told WSYX he was given the option of five years probation or one year with a vaccine.

    “Everyone had this look on their face,” he said, according to WSYX. “I broke character and asked (my attorney), ‘Can he do this?’ ”

    He said he expressed hesitation about the vaccine in court.

    “I know he’s known for giving people max time, jail time, all that,” Latham told the TV station. “I don’t want to go to jail. I also don’t want to have five years probation.”

    Latham said he planned to reach out to the American Civil Liberties Union on the condition.

    An ACLU lobbyist compared the requirement to judges ordering convicts not to have children.

    “At minimum, it appears to be problematic,” Gary Daniels told the newspaper.

  10. We must flatten the curve. In two weeks we'll be back to normal. 18 months of lockdown later it's, we'll be knocking on your door to check for vaccine papers. Even I did N-A-Z-I that one coming.
    Won't be long before a East Germany type state like Illinois will be checking people with out of state plates. Papers please. No jab verification? Arrested, detained in a Covid violation camp and given the choice. Get the jab, pay a small fine and promise to keep up with all new jab protocols, or take your chances in our Covid Kangaroo court system. Sounds ridiculous? Give it one year, two max and this will be the norm.
