    You do realize that every court decision so far has upheld vaccine mandates.

    All the previous court decisions back to 1905 in the supreme court have upheld vaccine mandates.

    There’s no Government EO or Law, everything is Business’ making their own decisions, banking on the Government’s future actions.

    Once Biden puts his ice cream down, pops his head out of the basement and gets it done, it will be struck down and then business owners will have a precarious decision to make.

    Good luck with your assertions. There is no evidence that the employer vaccine mandate will be struck down in any higher court. And all the legal precedence in the U.S. supports vaccine mandates. Including allowing employers firing people who refuse to get vaccinated who will not be eligible for unemployment payments.

  5. A private employer fires someone who after putting in a vaccine requirement, this employee decides they dont want to get vaccinated. This is the private employers decision and thus fires the employee. Employee sues and court finds private employer has right to put policy in place and worker did not meet one of the accepted exemptions.

    However, here we have federal government mandating to private businesses all their workers be vaccinated and if not they will be fined heavily. So private company fires employee and employee sues because it is the federal government forcing the private employer to fire the employee.


    These are two vastly different scenerios and present quite a problem. Vaccine mandates in teh past were upheld in schools which are public domains and even were extended to private schools. But this is a different ball game.

    You cannot simply extend precedent based on the legal principle of opinion that "this is not the same thing but i feel it is close enough"

    There is quite a legal challenge coming...

    Take a look at all the other OSHA regulations and rules passed by the government mandating safety and protection of health in the workplace -- backing the requirements with large fines -- and get back to us.

    Mandates from the government for workplaces have been in place for a long period of time.

  7. the government mandating you wear goggles and glvoes while oeprating machinery is not really controversial.. who is going to object to wearing goggles and gloves when ther ule making was supported by evidence how such measures reduce workplace accidents and loss of eyes or limbs.

    You cannot just whitewash a general sweeping hand. vaccines for adults in the workplace are quite different than mandating bathrooms, saefety equipment or ventilation.

    When cases drop to a number that is reasonably risk-less, I don't think the courts will allow someone to get fired for not getting the vaccine

    of course there is no current government rule for mandatory vaccines If they want to use OSHA it needs to enter the Federal register first.....Its not a quick process

    Yet a long list of vaccinations are required in the U.S. for a child to attend their first day of school. Think it over. Soon Covid vaccinations will be added to this list.
