    Spain’s Supreme Court Rules Against Using Vaccine Passports to Restrict Access to Public Spaces

    It’s the first time a high court of a European Member State has challenged the use of vaccine passports domestically.

    Spain’s Supreme Court made waves last week by becoming the first judicial authority in Europe to rule against the use of covid passports to restrict access to public spaces — specifically hospitality businesses (bars, restaurants and nightclubs). It is not the first Spanish court to come out against vaccine passports but it is the most important. So far, only five of Spain’s 17 autonomous regions – the Canary Islands, Ceuta and Melilla, Andalusia, Cantabria and Galicia – have proposed using vaccine passports to restrict access to public spaces

    Now that the FDA has formally approved Pfizer and BioNTech’s COVID-19 vaccine, more employer vaccine mandates are rolling in. And while some companies may be worried that mandatory vaccines might cost them employees during a nationwide worker shortage, a new survey shows that vaccine requirements could give them more customers.

    Over half (53%) of surveyed Americans said they would be more likely to shop in-store at businesses that require all employees to get the COVID-19 vaccine, according to an Ad Age-Harris Poll.

    And Gen Z-ers are even more receptive to vaccine mandates, with 62% saying they’d be more likely to shop in-store where employees are required to be vaccinated, whereas 48% of millennials, 51% of Gen-Xers, 54% of boomers and 70% of people ages 76-93 say the same. The survey polled 1,028 people over the age of 18 from Aug. 13-16.

    Big companies like Disney DIS, +0.46%, Lyft LYFT, +0.91%, Google GOOGL, +0.87%, Facebook FB, +0.59%, Twitter TWTR, -0.23% and Walmart WMT, -1.03% had said even before the Pfizer vaccine received full approval that at least some of their employees had to be vaccinated.

    But the Ad Age-Harris Poll found that 47% of those surveyed believe that employers should require all employees to get vaccinated against COVID-19, and that 64% believe mandatory vaccination is the only way that the U.S. will recover from the pandemic.

    President Joe Biden encouraged employers to put vaccine mandates in place after the Pfizer vaccine received FDA approval.

    “Do what I did last month. Require your employees to get vaccinated or face strict requirements,” Biden said on Monday, referring to the requirement for many federal workers.

    And consumers also want to know if a business is requiring vaccines. The poll found that 69% of those polled said consumers have a right to know whether or not a company is requiring its employees to get the vaccine. What’s more, 76% said that if a company is requiring vaccines, they should put it in their advertising.

    Nearly half of those polled (49%) said that they’re more likely to shop in-store if customers are required to be vaccinated, too. As the delta variant continues to spread and COVID cases rise, more businesses are indeed requiring proof of vaccination from consumers.

    Danny Meyer, head of the Union Square Hospitality Group and Shake Shack founder, said that Union Square Hospitality Group would be insisting that patrons who want to sit inside be vaccinated. The San Francisco Bar Owners Alliance, representing more than 300 establishments, is calling for bar customers to show proof of vaccination or a negative COVID test to enter bars. And New York City is requiring all patrons to prove vaccination in order to visit indoor restaurants, bars, gyms, public performances, museums and other venues.
