    Four-year battle between David Boies, Alan Dershowitz turns uglier following financier’s arrest

    The arrest of Jeffrey Epstein is escalating a long-simmering fight between two of the nation’s best-known lawyers, Alan Dershowitz and David Boies.

    The men were friendly, if not exactly friends, until 2015. That’s when Mr. Dershowitz learned Mr. Boies was representing Virginia Giuffre, a former Florida resident who had alleged Mr. Epstein sexually abused her as a minor and prostituted her to his friends, including Mr. Dershowitz. Mr. Epstein has pleaded not guilty to charges of sex-trafficking of minors and conspiracy.

    The allegations against Mr. Dershowitz, which he denies, sent the retired Harvard Law School professor on a four-year campaign to clear his name and persuade authorities to investigate Mr. Boies for professional misconduct and extortion. This spring, Mr. Boies, 78 years old, sued Mr. Dershowitz, 80, for defamation on behalf of Ms. Giuffre.

    “He’s now trying to destroy me and destroy my reputation, destroy my economic situation, destroy everything,” said Mr. Dershowitz of Mr. Boies in an interview. “I would put my sexual probity up against David Boies’s any day of the week.”

    In response, Mr. Boies said Mr. Dershowitz is just trying to distract from the allegations by Ms. Giuffre, whom Mr. Boies is representing pro bono.

    “He wants to make this between him and me,” Mr. Boies said. “For some unknown and unknowable reason, I’ve decided to go after him. That’s absurd. It’s disproved.”

    The sex-trafficking case against Mr. Epstein has implications for both lawyers as they enter the twilight of their careers.

    For Mr. Boies, representing Ms. Giuffre and other alleged Epstein victims could help shore up his standing following criticism for his aggressive defense of Hollywood mogul Harvey Weinstein and efforts to muzzle employees of blood-testing company Theranos Inc. Mr. Boies has said he was defending his clients’ interests.

    For Mr. Dershowitz, accused of serious crimes, the stakes are far higher.

    In the 1980s, Mr. Dershowitz successfully defended Claus von Bülow, erasing his convictions for attempted murder of his wife, Sunny. In the mid-1990s, he helped handle O.J. Simpson’s successful defense. He was the youngest full professor in the history of Harvard Law School and has written more than 40 books.

    Mr. Boies represented the U.S. in its historic antitrust case against Microsoft Corp. He later led the litigation to overturn California’s Proposition 8, which defined marriage as between a man and a woman.

    The lawyers first met in the late 1970s, Mr. Dershowitz said, when Mr. Boies was chief legal counsel for the Senate Judiciary Committee. Mr. Dershowitz was an outside adviser to Sen. Edward Kennedy, the committee chairman and Mr. Boies’s boss.

    Both lawyers worked for Democrats in litigation over the contested 2000 presidential election. Mr. Boies represented Vice President Al Gore in the U.S. Supreme Court case that effectively decided the outcome of the presidential election in favor of George W. Bush. Mr. Dershowitz, also a Gore supporter, litigated in the lower courts.

    “I remember during Bush v. Gore, people working on the case would laugh when he purported to pontificate about the case,” Mr. Boies said.

    “Look at what he says about my career. Just think about that. I’m not a distinguished lawyer,” said Mr. Dershowitz, laughing.

    Mr. Dershowitz said he met Mr. Epstein in 1996, when a mutual friend introduced them and Mr. Epstein showed up at his Martha’s Vineyard, Mass., home with a bottle of wine. The friendship developed after Mr. Epstein flew him to a star-studded birthday party for retail magnate Leslie Wexner, according to Mr. Dershowitz.

    As Mr. Epstein’s defense lawyer, Mr. Dershowitz helped negotiate a 2007 nonprosecution agreement with federal authorities and a plea deal with Florida prosecutors, which has been criticized as too lenient. Mr. Epstein pleaded guilty to two state prostitution-related felonies and served a 13-month prison sentence with work-release privileges that let him spend much of his time outside prison.

    Allegations against Mr. Dershowitz related to young girls first surfaced in December 2014, in a civil case between Mr. Epstein’s alleged victims and the Justice Department over the agency’s handling of the Epstein investigation.

    Ms. Giuffre described in documents in that case sexual encounters with Mr. Dershowitz in Mr. Epstein’s mansions in Palm Beach and New York City, at his vast desert ranch in New Mexico, at his private island in the Caribbean and on his private planes, all while she was a minor. A federal judge in Florida ultimately ordered Ms. Giuffre’s allegations stricken from the record in the victims’ rights lawsuit against the Justice Department.

    Mr. Dershowitz, married with three children and two grandchildren, said her story was completely fabricated, including even her assertion that she was a minor during the time period in question. His wife, Carolyn Cohen, says she “has no doubt, not even an inkling” about her husband’s innocence.

    Mr. Dershowitz met and spoke with Mr. Boies several times in 2015, both men say, about Ms. Giuffre’s claims. He presented Mr. Boies with an account of his whereabouts during the period that Ms. Giuffre alleged she was abused by Mr. Epstein. He said he had records showing he couldn’t have been in the same place at the same time as Ms. Giuffre.

    “I was initially very impressed with the representations he made,” Mr. Boies said.

    Mr. Boies said his firm began uncovering material that cast doubt on Mr. Dershowitz’s account, including flight logs from Mr. Epstein’s plane that Mr. Boies said contradicted Mr. Dershowitz’s claims that he never traveled without his wife. Talks collapsed in late 2015.

    Mr. Dershowitz said that he was never on Mr. Epstein’s plane with underage women.

    Since then, Mr. Dershowitz has filed bar complaints in Florida, New York and Washington, D.C., accusing Mr. Boies of misconduct. The complaints were dismissed. None of the complaints led to sanctions.

    Mr. Dershowitz says he has also urged prosecutors and federal agents in New York to investigate Mr. Boies for alleged extortion.

    In court filings, Mr. Dershowitz said he believes Mr. Boies and Ms. Giuffre’s other lawyers tried to make a public example of him, while trying to shake down Mr. Wexner, chief executive of L Brands Corp.

    Between December 2014 and July 2015, Mr. Boies and his partners had discussions with Mr. Wexner’s attorney “regarding possible claims against him,” according to a 2017 affidavit by Stephen Zack, a partner at Mr. Boies’s firm.

    Ms. Giuffre has made no public claims against Mr. Wexner. Mr. Dershowitz said he believes that Mr. Wexner was spared for one of two reasons: either he entered into a secret settlement with Ms. Giuffre or Ms. Giuffre’s lawyers didn’t trust anything she said against Mr. Wexner.

    “We never made a demand to Wexner. Wexner never paid anything,” Mr. Boies said. He added that he believes everything Ms. Giuffre told him about the sexual abuse she endured.

    A spokesman for Mr. Wexner declined to comment. Mr. Wexner said in a memo to Victoria’s Secret employees Monday that at the time he wasn’t aware of Mr. Epstein’s alleged criminal behavior and regretted crossing paths with him.

    Mr. Dershowitz has continued to attack Ms. Giuffre’s credibility in defense of his own.

    In April, Mr. Boies sued Mr. Dershowitz on behalf of Ms. Giuffre for defamation in federal court in Manhattan, accusing him of spreading “intentional, outright lies” to distance himself from the scandal.

    Mr. Dershowitz said he is determined to put Mr. Boies on the stand in this case or another. Mr. Dershowitz said he has evidence that Mr. Boies knowingly aired allegations about Mr. Dershowitz that lack credibility.

    Mr. Boies said his firm investigated Ms. Giuffre’s claims and gave her a polygraph, which she passed.

    The defamation lawsuit includes statements from a woman, Sarah Ransome, who alleges Mr. Epstein prostituted her out to Mr. Dershowitz when she was in her 20s and from a former Epstein employee, Maria Farmer, who says she witnessed Mr. Dershowitz hanging out with underage women at Mr. Epstein’s New York City townhouse.

    Mr. Dershowitz says he didn’t meet Mr. Epstein until after Ms. Farmer had stopped working for him. Mr. Dershowitz denies paying for sex with Ms. Ransome.

    He said there is evidence under seal about Ms. Giuffre and Ms. Ransome in another lawsuit in Manhattan federal court that clears him.

    The material includes email exchanges Ms. Ransome had with a reporter in 2016 in which she claimed, without evidence, she possessed sex tapes involving about a half dozen famous people, according to Mr. Dershowitz. Mr. Dershowitz is also trying to unseal a draft memoir by Ms. Giuffre about her relationships with Mr. Epstein and his friends. The memoir does not mention Mr. Dershowitz having sex with anybody, he says.

    A spokeswoman for Mr. Boies said the manuscript was never meant to be “a complete recitation” of the abuse Ms. Giuffre says she suffered.

    A federal appeals court recently ruled that the case should be unsealed.
