What regulations/limitations are there in promoting your fund online?

    Assuming you have your own hedge fund/managed futures biz and you have a website to promote yourself, what are the dos and don'ts regarding the information you can place on your website.

    The reason i'm asking this is because i see quite a few sites that says "Regulations prevent us from saying anything about our fund here. Please contact us directly"

    Can't tell you much about securities, but in futures, The NFA has very strict guidelines about that, and you can see them at their website under information for CTA's. There are definite dos and don'ts about how you can portray your returns, risks, etc., as well as mandatory risk statements that must be included in all advertising. Their compliance people are really good about reviewing your promotional material up-front to make sure that it conforms, and they are also more than willing to give informal advice and help you when you are getting started. If you portray yourself to the public as managing money in pretty much any capacity, you will, of course, need to register both yourself as principal and your CTA.

    In a website, you can certainly post your disclosure document and any promotional material that conforms to the disclosure rules. Most sites that do that have a risk statement that you have to read to be able to click through to the rest of the site. Anyone that can't/won't post their stuff, and says that it is because of "regulations" either doesn't want to post a full-disclosure risk statement (they can be pretty scary to new investors) or their whole track record (you aren't allowed to "cherry pick" in any fashion), or something like that, or just wants to get you on the phone to sell you.
