  2. No. Both DACA and DAPA were implemented by Obama simply making announcement.
    There was no round of hearings, notificatons, public comment period etc as required by the Administrative Procedures Act.

    So Obama IMPLEMENTED both without following procedural requirements even though it got away with it because what was done was done. Then when he tried to end DAPA the courts required him to meet administrative procedural requirements. It is the ending of DAPA that set the court precedent for administrative requirements, not the implementation and not the implementation of DACA eiither.

    Thus, as I said, unlike your assertion that Trump ran a shit show by not following the administrative requirements- versus Obama- Obama violated the requirements in unilaterally implementing without hearings, notice, and all the other requirements. He simply got away with skipping that part because all his lefty buddies wanted to see DAPA and DAPA become permanent. The they brought out all the legal challenges when it was at risk of going away.

    Obama = shit show.

  4. As I say, your view does not matter at this point. The Court will probably take up DACA in the next session or maybe after the election and their opinion matters - yours does not.
