  1. Here’s fake news technique for you: “Pakistan goes into emergency session after Trump’s Tweet.”

Let’s break down how the media is able take to take three true statements and when put together, create a false impression.

    1. Trump Tweets - True
    2. Pakistan goes into emergency session - True
    3. The time Pakistan goes into emergency session is after the time of Trump’s Tweet - True

In reality, Pakistan goes into emergency session because of Iran’s civil unrest. They are concerned about the U.S. using their airspace against fellow Muslim country, Iran.

    18 U.S.C.
    United States Code, 2011 Edition
Title 18 - CRIMES AND CRIMINAL PROCEDURE
    PART I - CRIMES
CHAPTER 93 - PUBLIC OFFICERS AND EMPLOYEES
Sec. 1924 - Unauthorized removal and retention of classified documents or material
From the U.S. Government Printing Office, www.gpo.gov

§1924. Unauthorized removal and retention of classified documents or material

    (a) Whoever, being an officer, employee, contractor, or consultant of the United States, and, by virtue of his office, employment, position, or contract, becomes possessed of documents or materials containing classified information of the United States, knowingly removes such documents or materials without authority and with the intent to retain such documents or materials at an unauthorized location shall be fined under this title or imprisoned for not more than one year, or both.

    (b) For purposes of this section, the provision of documents and materials to the Congress shall not constitute an offense under subsection (a).

    (c) In this section, the term “classified information of the United States” means information originated, owned, or possessed by the United States Government concerning the national defense or foreign relations of the United States that has been determined pursuant to law or Executive order to require protection against unauthorized disclosure in the interests of national security.

    (Added Pub. L. 103–359, title VIII, §808(a), Oct. 14, 1994, 108 Stat. 3453; amended Pub. L. 107–273, div. B, title IV, §4002(d)(1)(C)(i), Nov. 2, 2002, 116 Stat. 1809.)

There are basically three different ways to transmit information within the State Dept.

Two of them are quarantined, secured and are not able to transmit outside themselves; Secret Internet Protocol Router Network (SIPRNet) and the Joint Worldwide Intelligence Communications System (JWICS) these are the systems used to send confidential, classified and top secret information. The fact that anything is on these systems means their content is classified.

The third is NIPRNet is able to send info to outside emails and such but is not connected to the other two. It is impossible to send anything from SIPRNet or JWICS to NIPRNet. It's set up that way on purpose so it cannot happen. The only way this can happen is for someone to willfully copy something from the first two and resend it which is forbidden. Everyone that has access to these systems knows this.

Yet over 1300 emails and memos that originated on either SIPRNet or JWICS ended up on Hillarys home commuter. The reason why most didn't have the original classification marking was due to the fact they were illegally copied and the classification markings left off.

The good news is she not looking at any more than 1300 years in prison.

I am very well aware of this statute but this has got NOTHING to do with your posts.

First, the information was not classified or at least you don't consider it a requirement for this law to be broken. So how is it relevant.

Second, you argued that the information should have been sent on classified channels but considering that the state department email system is not a classified channel and if Huma had forwarded those emails to another state department account, how would the scenario be any different? The emails she forwarded were NOT on SIPRNet OR JWICS in the first place so what exactly are you accusing her of here? She received this information in an unclassified email account so why should she be the one assigning the information a new designation that the original authorities did not?

As I already said, there is no way Hillary could break the law as an OCA, she is the last authority on what's classified and what's not for anything within the state department.

We were talking about Huma but considering that she forwarded an email she received on her state department email account (which is unclassified) and forwarded it to her Yahoo account (another unclassified account), what exactly is the crime here? That she emailed an unclassified email to another unclassified email account? How is that possible? Secure doesn't equate as classified.

The law doesn't give Hillary a pass, the law states " Whoever being an Officer, Employee, etc.

Hilary's home server was never authorized to receive or transmit classified info, and yes, SHE NEEDED STATE DEPARTMENT APPROVAL.

So transmitting and storing classified material on her home system is in violation of federal law.

And btw, the 1300+ emails in question, Hillary didn't originate, so she has no saying on their classified status.

But by that logic, why can't the President be accused of breaking the law? He is an employee of the government as well?

    That's just bad logic.

Using private email system is legal, she used a private email system.

Some of the emails contained classified information that were not properly marked, that's a problem for those who sent that information because they didn't mark it - not those who received. And anything Hillary herself sent is for herself to decide whether it's classified or not being an OCA. The law doesnt implicate her in anyway otherwise it would implicate dozens of people who emailed her with the info as well.

But there is even a more important point, EVEN IF she used the state.gov email system, that is still an unclassified channel and the same scenario would have happened. So she would have violated the law for using either of the systems?
