Mandatory gun insurance for gun owners might be the answer. Then, you kill someone because you are wacked, the insurance company gets nailed. Guess what, the insurance company is going to do it's due diligence and run background checks on you. The only problem is that gun usage isn't like a car, in that you don't have lots of statistics. However, it might be like flood insurance. That is probably the free-market answer.
