    Tesla's bid to emerge from "delivery logistics hell," as CEO Elon Musk put it a week ago, this quarter includes a "door-to-door" service called Tesla Direct. At least, in some areas, including the Los Angeles metro area. "This is an exciting opportunity to get your hands on your car sooner and without having to go pick it up," local delivery manager Jeremy Pomp emailed customers.     Yes!! As I've stated before, this is a relatively clear and straightforward case.

    Hopefully the DOJ & the FBI will follow up with criminal charges.

    Looking forward to reading news of Elon Musk's arrest.

    I guess it's now fair to say that massive damages from various types of lawsuits against Elon Musk are secured. As high as a few billions to over 10 billions, enough to bankrupt Tesla, Elon Musk, and perhaps some of the board members.

    Some thoughts:

    Musk's future at TSLA
    Will he step aside from CEO role? Probably not
    NY Times' Jim Stewart on CNBC: TSLA board wanted an excuse or "cover" to get rid of him, and the SEC lawsuit provides that cover
    Is Musk leaving CEO role a positive or negative? Very likely a negative for the share price, because so many people have bought the stock because they believe he is a visionary.

    Merits of the SEC lawsuit
    NY Times' Jim Stewart on CNBC: Lawsuit is based on statements made by Musk (presumably when interviewed by SEC). Eg. The $420 price was partially based on its role in marijuana culture.
    MUSK'S TWEET ON $420 PRICE WAS TIED TO MARIJUANA CULTURE: SEC
    MUSK THOUGHT HIS GIRLFRIEND WOULD FIND PRICE HUMEROUS: SEC
    Therefore the lawsuit has strength because it's based on Musk's own words (not just about the $420 price) in that interview.

    Negatives
    * Regardless of the outcome of the trial, difficult for some shareholders - expecting those managing money for other people - to continue to own TSLA while the court case has not been finalized
    * harder for company to raise much needed capital
    * SEC has given civil lawsuits a help - shareholder lawsuits can rely upon the SEC's arguments
    * possible future criminal charges against Musk
    * Musk's (personal) lenders would not be happy, given his margin loan:

    "You know what banks holding shares as collateral really love? The guy they loaned money to being sued by @SEC_Enforcement for fraud while also under criminal investigation for the same, that's what."

    Possible positives
    * 2025 bonds reached a low of 81.90 in early September, and this level has held (so far)
    * Stock reached a low of $252.25 in early September, and this level has held (so far)
    * the bonds and the stock are both stronger than they were in early September, before the SEC charges were known.
    * Could it be a positive for long-term company performance (not share price) if Musk is no longer CEO - especially if he stays at the company in an operational role?

    Some existing car company will probably buy this POS company at about $2.00 per share, or more likely out of bankruptcy. They do not have adequate capitalization to survive. Disclosure I worked in the Auto industry for a manufacturer and as a vendor for 20+ years. I have 2019 puts on TSLA.
