Death penalty has more clear premeditation and higher standard of mens rea in the crimes up for death penalty. I do not think this one qualifies to be honest.
Yes, the bar is very high for the death penalty. The one bar this case clears however is there is no dispute (due to the video) that these are the two men who did the shooting.
I am happy to talk about this case. From what I read, the officers were looking for a suspect who lived in a different part of the city and was already in police custody. They barged into the house and the homeowner fired back defending themselves not knowing who was coming in the door in the middle of the night and the officers fired back killing the woman. Police officers who carry weapons and have the right to use them should carry really high standards of care in when they use them. let me see if I got this right: 1. Police went to the wrong home 2. Police barged in after getting no answer at the wrong home in the middle of the night 3. Suspect who was subject to the warrant lived in a different part of the city and was already in custody. Due to the above negligence and stupidity that any regular human being would be able to avoid, but here we have supposed trained professionals licensed to carry a weapon, a person was believed to be legally defending his home before the police fired back and killed the woman. The negligence alone warrants firing because they do not belong in a police uniform. Manslaughter is certainly a viable charge as negligence led to the wrongful killing of a person. Whether the police officers would be convicted of manslaughter and sentenced to prison is unlikely so a civil suit seems the clearest path to punish the police officers since their supervisors did not properly teach how to read an address or verify they knew how to read a map.

Travis McMichael called police on February 11 at around 7:30 PM to report an unknown "lighter-skinned black male," wearing a red shirt and white pants, was trespassing on a construction site in Brunswick, GA ... this according to a police report obtained by TMZ. In the report, cops say McMichael told them he saw the black male cut across one property and enter the construction site. McMichael told cops he returned to the property and "observed the unknown male run back through the open house under construction toward the area of the back yard." Cops responded and searched the property, but no one was there. They say the property owner, Larry English, told them "it appears the unknown male is only trespassing and plundering around as he has yet to see where anything has been taken." Cops say security footage of the incident circulated Facebook and a neighborhood watch app but nobody could identify the unknown black male. Another neighbor, Diego Perez, says he was also present for the Feb. 11 incident, along with Travis and his father, Gregory, at the February 11 incident. It should be noted ... the police report never mentions Gregory or Diego. Diego told the Atlanta Journal-Constitution he was there because Larry English -- who was out of town -- sent him the security cam footage, and asked him to go check it out. But, Perez says he was also on the scene Feb. 23 right after Ahmaud was shot. He claims Ahmaud is the same person the McMichaels confronted 12 days earlier. As we've reported ... Travis and Gregory were arrested for murder and aggravated assault shortly after the chilling video of Ahmaud's shooting leaked last week. It's interesting that the younger McMichael described the Feb. 11 trespasser as "lighter-skinned' ... because Ahmaud had a darker complexion. Unfortunately no one watching the video can say it was Aubrey for sure. Let's assume it wasn't, then these 2 stopped a guy on the street with a shotgun to try and subdue him without any authority and why wouldn't a Black guy panic when two guys stop a truck in the middle of the road and come at you with a gun? There were no robbery complaints filed at all in the neighborhood according to one police report and the homeowner did not report anything missing so there was no motivation for these 2 to stop someone they thought looked like someone from a previous event. Let's assume that i was, the homeowner did not say anything was stolen so no felony crime was reported, at worst it was a misdemeanor tresspassing which is a really low offense. these 2 have no right to make a citizen arrest first of all for a crime they alleged happened 1-2 weeks ago. Second they have no proof that Aubrey did anything wrong at the time they stopped him to make the so called citizen's arrest. So in both cases they are still wrong. The video is being released so the white guys can claim like they always do in these cases that the innocent victim did something wrong previously so it was ok that he was killed in this incident....
