What a poor argument This seems to be the new dogma of the left....self defense only applies if you are shot or stabbed first. and until that happens you don't need a gun with you. The DA in Kenosha made the same argument If someone is suspicions , someone who breaks laws, why not prepare your defense when you approach him to talk, Why would you approach him defenseless to ask him why he has been trespassing, A question like that can be a trigger.
There had been a rash of break-ins in the neighborhood, including Travis's car. They saw Arbery a few nights before at the same house, tugging his shirt like he had a weapon. What Travis didn't know was that Arbery had many previous encounters with the law and was on probation. Any out of line conduct and he was going to prison, and that may have factored into his desperate reaction grabbing the gun. What was Travis supposed to do at the point they were wrestling for the gun?

Threatening with a loaded gun in a public street IS ASSAULT in law so when the victim responded instinctively after being chased by trucks, that's not his fault. You don't get to bring a gun into a situation just because you have a gun. It will provoke a response that's on you if it goes very wrong. I don't doubt the homiside was unintentional but it was brought on by Travis who had just prior commited the crime of threatening with a gun. We don't know what happened with the trucks but I'd expect there were moments when the victim thought he might be run over. I would sentence myself to five years minimum had I done what Travis did.
I saw some of the closing I do think the defense is doing good The State is using the same argument that was done in Kenosha Saying that there was no need to have a weapon at the encounter because the suspect was not armed. Of course that is only known now after the fact The State wants you to assume the suspect had no ulterior motives Why is he at a vacant house at night ...Is he using it for a gun drop or drug drop.
Too many Americans excuse this kind of criminal behavior which helps ensure it keeps on happening. You can't just kill people then claim it was all a tragic misunderstanding. There has to be a strong deterrent out there to persuade other dumb assholes and/or racists from doing this.
I hate it when I'm being serious and then I see I spelled homoside arseways I remember was a young teen one day realising that running away from the police was a capital crime, at least in US TV shows with "Stop or I'll shoot". I expect many mall ninjas never have that moment where they think, "hang on, that can't be proportional and so not what really happens".
