    This is a gray area in law. Trump used Article IV Section IV of the constitution to justify sending Troops to the Border. It was not challenged. Had it been, there is no telling what the outcome would have been. Could the administration have convinced the Court that an "invasion" was underway?

    There are only four legal exceptions to posse comitatus: By Act of Congress; or as permitted, or required, by the Constitution; as allowed under the Enforcement Acts, which predate Posse Comitatus, and Posse did not specifically recind, and as allowed under the modified Insurrection Act. (Ike used the Enforcement Acts to call up Federal Troops.) My guess is that Trump's recent use of Troops on the Border would probably be ruled illegal were it challenged. Could he use Troops legally to construct a wall using DOD money, even if not authorized by Congress. Possibly. It might depend on whether such use is deemed by the Court as a law enforcement activity, in which case it would be illegal under Posse Comitatus, or to prevent an invasion, in which case it would be legal, under the Constitutional Law exception to Posse Comitatus. It would seem neither the exceptions allowed under the Enforcement Acts or the Modified Insurrection Act would be germane.

    My personal opinion is that the chance of Trump shutting done the government again is zero. His options are limited and all bad. If he declares a national emergency, he'll be laughed at publically, and the Courts will intervene. If he tries to use federal troops to build the wall he'll be, once again, skating on thin ice. His best option among bad options, is to divert DOD money to private contractors and try to get the emminent domaine cases through the courts in his favor before his time runs out. I think what he will actually end up doing is lie and say, "Nobody knows more about Borders than I do!" Then he'll take credit for some existing or new fencing authorized by prior administrations and call it a "wall". Then he'll lie some more and tweet that drug smuggling and illegal border crossings are skyrocketing, because the "open Border" Democrats are terrible people and wouldn't give him what he asked for. No doubt there has never been a negotiator in the White House quite like Donald Trump. And thank god for that!
