you yourself have admitted the SC will punt taking up the case already giving a criminal a pass on insurrection. The SC will not take up a case w/o an outstanding appeal so a state may as well bring suit knowing it will need to be addressed. Where's the rules for the insurrection clause needing a jury? (as far as I can tell, it's uncarted territory). A state has the right to bring election interference charges.....there's a plethora of federal crimes a state will act in preventing....if the feds fail to act, does the state not have a responsibility? FWIW, I get that Texas is attempting to usurp the very power from immigration enforcement though they've failed to demonstrate damage to the state by immigration.
This may be the time to point out again that numerous candidates have been removed from the ballot by state courts and/or state officials using the 14th Amendment Article 3 since the post-Reconstruction period (later than 1900). Most of these candidates were removed for being socialists or communists. Not a single one of them was convicted in a criminal trial. There is no requirement that a candidate be convicted in a criminal trial (or found responsible in a civil trial) for them to be removed from the ballot or office as per the 14th Amendment Article 3. This principle has already been established in all the previous legal action.
Are you referring to candidates in elections entirely within the State or ones with federal effect becuse removing a state senator is entirely within a state....not a presidential candidate who many people in Colorado want to vote for.... cite some of the cases and compare for yourself and see how if they are comparable...

He/She doesn't know what they are talking about. There have been only 2 disqualifications under Sec 3 since 1900. Both were convicted of crimes against The US. --In any event, whether Trump is convicted or not, Sec 3 of the 14th does not apply to the President.
