HARRY your absolutely RIGHT and I totally agree with you. That is totally Fair and anyone can see that ... so why do you think traderbrad is not doing this ?
It's simple! Four grand means more to him than it does to you! Any smart business operator would have seen the negative result of not refunding your money-so you have to ask yourself why didn't he just do it after you posted about him here? He needs the money! He could easily have garnered a great deal of good will and made himself look like a champ to boot probably picking up some more gullible, vulnerable, desperate clients in the process.
yep..."traderbrad" really blew it by letting his ego get in the way. Opportunity came along to create a win/win situation.... but brad showed that he'd rather be "right", imho! Even if he is technically correct... the ill will and acrimony is more damaging than any (private) negotiated resolution of the refund issue. :eek: Wonder how that manifests itself in relation to the markets he trades!?!
Samson, that is why you should always pay for these things with a credit card. I don't know about Canada but in the U.S. if you aren't delivered the product and the seller doesn't have your signature on the charge slip, you can get your money back simply by disputing the charge. As an example, I signed up for Avid's free trial of their signal service. They required a credit card but you were supposed to be able to cancel within a certain number of days. Well, I didn't find the service of value to me so I canceled. But they charged my credit card anyway, wouldn't reply to my emails to cancel and didn't issue a credit to my card. So I just disputed the charge. They even tried to charge me again the following month so I disputed that one too. I guess they got tired of paying the chargeback fees to their merchant account provider because they finally stopped the charges. Still, I never did receive any reply to my emails and they don't list a phone number. Oh well, it didn't cost me even though they obviously never intended to honor their free trial offer. In your case, since the seller didn't deliver the product that you paid for, you would have a ligitimate claim to dispute the charge.
I read in another thread that traderbrad does not accept credit cards. If that is true, then he probably is aware of what you say in your post and that is WHY he does not accept credit cards. It appears the man covers his bases...LOL.
He doesn't trade his own system signals according to another post so he needn't concern himself- he's free to do as he wishes, dumb as that may be.
richard, while i echo your sentiment concerning traderbrad and his disturbing business methods; i must disagree with your assertion that elitetrader.com could be held liable in a class action or any other type of law suit. elitetrader is a publisher and marketing forum--- i don't believe that a publication was ever held liable for the content of its advertising in history. this would create a chilling effect over the entire media world hence is avoided by US judges, lawmakers. even in the grandest class action of all time, tobacco, were publications carrying the ads found liable. surfer
Marketsurfer I respectfully disagree with your legal opinion in today's environment. If I were Baron, I'd cover my ass! Why stick your neck out when it's so easy to play it safe? Unless Baron has nothing to lose- no assets, no house, etc. In that case who cares? BTW, we're not talking about damages arising from advertising!
If I may add to this my thoughts about ET and there sponsorship from traderbrad. If anyone has reason to be angry about it , it would be me. I emailed Baron to let him know about this thread and his response to me was VERY fair and professional. Just so everyone knows. Although I have a serious issue with this vendor as long as ET remains honorable and fair and allows me to post the truth of my experience with this vendor I have no problem with them. ET is a forum after all and that is what I love about it so much. It should be about free speech and it should show all sides of every story and allow the reader to decide.
