I'll tell you what is criminal however------not enforcing border laws and purposely allowing immigrants into the country to, in part, affect the 2030 census.
All that being said, Trump has already been acquitted in The Senate. There shouldn't even be a case pending.
Article I, Section 3, Clause 7 specifies that a President impeached by the House and convicted by the Senate is nevertheless “liable and subject to Indictment, Trial, Judgment and Punishment according to Law.”
It doesnt matter your opinion on whether he committed a crime or not in your eyes..that is not the question. Does he have immunity from criminal prosecution...NO. Stay on topic.

Presidents have immunity from criminal prosecution for official or unofficial acts during their presidency that they have not been impeached and convicted for. In this case, it's clear to even the folks bringing the charges, that Trump has done nothing illegal. And when there is a Senate trial that has resulted in acquittal, there can be no charges later.
President must have this type of immunity so that they can perform their duties without fear of retribution like Trump is going through. This would be correct for all presidents from any party.
