    Road and railroad closing in/out impacted towns/cities was regularly done for the 1918 flu.

  3. States and municipalities have considerable powers related to health and safety emergencies.

    Not sure that makes the Riot Control Act a proper exercise of power just because they dont have proper legislation or ordinances on the books. But I dunno. I would have to see the language of it. And if people want to gather to protest anything there in Gallup, I bet the Riot Control Act would cover that too. Or could be made to cover that if needed.

    There were plenty of civil liberty violations and excesses in the Spanish Flu as well so the fact that something has been done before does not immediately provide a a legal basis. In addition, the country was at war in 1918 and the War Powers Act or whatever it was called then was a wild card that was invoked to cover just about everything needed to keep the country functioning so language of state and local legislation or absence thereof was not a problem.

    Note above that I said that government has considerable powers in this area so they can properly arrive at some of the things they want to accomplish. But they also have considerable power to abuse. There's a lot of "I think I can find a statute somewhere to cover that" going on right now.

    I don't think Governor shutdown is going to be able to block our exercise of constitutional rights for as long as he planned with his timeframe.

    For instance....

    There are millions of Catholics in CA and we can't receive Communion via Zoom. If the church wants to push this and the develop protocols for observing social distancing and the Church desired to a be plaintiff... I think the Church would win unless the state has data and info about the virus they are not sharing.

    However, the Pope sided with Govt (as the pre commie he is) a few days ago... so I wonder if the Church wants to be a plaintiff.

    I do know this... I wonder how the churches will survive without people in attendance donating money. My solution... would be outdoor services a microphone a stage small pizza paddles and a Communion glove. No chance the state could win against based on the info we know, if this were to get to the Sup Ct.

    I love the poster of newsome... its beautiful to my eyes...

    Gov Shutdown... has very limited time on this unless they present new data... transparently and it supports the shutdown.

    (that is my guess at this stage. CA may be liberal but many of those liberals don't have ton of money and they live in small apartments. We are not a stay at home culture. )

    We should get rid of state governments.

    The country could be federally administrated. One income tax. One set of laws that are uniform across the country. What everyone has learned lately is that we don't need governors, their taxes or their state police.

    I respect your opinion on that... and you make good points.
    my take is the opposite.
    The less diffused the power the more chance for abuse.
    No federal income tax... tarrifs for funding... the way the founders set it up.

    In CA
    If this shutdown were to last a few years...
    My family and I will move to a state with a smarter governor.

  9. I don't think the founders were anticipating Governors and Mayors acting as if they were Kings and Queens ruling by decree. When they so obviously trample civil liberties and abandon the constitution one might think it not too much to ask that they at least would want a semblance of a legislative process before doing so
