The software update simply adds a layer of control to FSD to prevent users from gaming the system. Do you sue Porsche for making vehicles that exceed speed limits? This lawsuit hasn't been decided and will go to appeals if necessary. FSD requires vigilance from drivers and FSD has proven safer than human cooperates vehicles . But it's not perfect and will likely require several other iterations before it can get to level 3 and above, including review of the legal implications of what level 3 and above is. Personally I would never have a system drive me. It may be the future, but not my future.
