In the case of Kerviel it was not clearly a fraud, all he did was executing positions beyond his allowed limits, trading itself was not fraudulent.

This is absolutely an ignorant statement. If I understand you correctly, anyone going to work and getting the best wage and bonus he can possibly get is greedy? It is the employees job to make money for the employer.
