4 and 5 were a backwards way of making the constitutional point. his previous statements should have had no bearing on this decision. Even if he said he hated muslims, so what... it was not a muslim ban and what his policy was constitutional.
The opinion is disappointing in that it suggests an explicit ban on muslims would violate the First Amendment's establishment clause. That is nonsense. The president might not be able to issue an order banning the practice of islam in the US. But an order banning entry of muslims would impede no one's practice of islam. It would just affect whom we let into the country. Muslims living overseas have no claim to the protection of our constitution. That should be so obvious as to not require explanation. Still, Roberts got it wrong.
