It's not discrimination in a negative sense if the candidates are equally qualified based on the initial attributes considered. The college has a diversity goal, so it used a diversity attribute to break the tie. Remember, we're in this place because of historical discrimination (in the negative sense) which has resulted in a marked disparity in initial conditions. That disparity is declining, probably in large part to these practices.
