No. Many people resided in the United States at the time of the drafting of the 14th amendment that were not citizens. As a matter of fact the United States was just as diverse with immigration in the 18th century as it is today. The law has always applied to those residing.
14th was ratified in 1868....founding fathers were long dead. No it was not a screw up..... any person in the United States is entitled to these protections under the constitution. The first part of the clause was to grant citizenship to the enslaved so that their rights would be protected and extend Bill of Right protections form the States to citizens. The drafters could have said citizen again but chose Person because the State's power is checked also against anyone in their jurisdiction whether a citizen or not. You think if a foreigner comes here and goes through a stop sign, the cops can beat him and throw him in jail for a week and claim "sorry the constitution does not apply to you..." It was to check the power of the state to take away rights granted to all citizens as well as violating due process and equal protection to ANY person. UNfortunately the South violated the 14th Amendment so bad for almost 100 years, Congress had to step in again and pass laws to remind the South and the Supreme Court of the 14th Amendment.
