They do this a lot on Amazon. They will say the book is new but the dust jacket is missing and there is just one giant tear on the front cover... but it is still in new condition... funny...

Hey Nanna, You know you can go for the creative financing rout. Just (If the books are as good as you say) go to Borders and return them. They will give you full credit.
