RIM patents -- can someone explain it?

  1. I just read that it looked likely the company suing RIM (NTP) would have it's patents rejected by the patent office. I don't get how it can sue based on patents that might be rejected -- how does that work and how can they win with invalid patents? Can someone explain this?

    I know laws in this country usually don't make sense, but this seems even more loony than usual....
