  4. It depends on the abuse. There are companies that put significant investment into training their employees. Think pilots, merchant marines, etc. If the employee gets the free education and then cuts and runs to another employer it's not particularly fair to the employer. If nothing else, I feel the new employer or the employee should have to pay the education cost back.

    most of those "training" jobs have policy in place where relocation/bonus has to be repaid if resigning within a certain period. You'd be kidding yourself if you think the cost of said training is not priced in w/that conditional compensation.

Pilots are trained across the board the same to meet FAA requirements so i a pilot leaves United to go to Delta, Delta is not gaining some competitive advantage unique to United as a secret. Highly skilled workers can change between intra industry companies as a comptition for labor.

    the only place a non compete can work is if you have a private company with partners developing specific technologies and client connections and a partner wants to bolt and go out on their own with all the work product developed by the company. It presents a tricky situation where non competes protect parties but these are very limited situations. Many non competes now are just abuses of the system.

  8. I've signed one non-compete in my life. It was for the only salaried job I ever had where I was market making Eurodollar futures. We had about 2 months of classes before we went live under a senior trader. I was not allowed to trade Eurodollar futures for a specific amount of time when I left which I thought was fair. I think non-competes make sense in both the training reimbursement and specific knowledge situations. I also feel employers should be fined for abusing the system, especially for low-skilled jobs where training isn't a large investment. Many times there will be gray area and there should be a way to arbitrate it fairly.
