registering a domain with a trademark?

  1. check online to make sure that it is federally registered. TM doesn't necessarily mean it is registered. If it is registered through USPTO and you can find it there, then I would avoid taking a website with such a close name as you would infringe their rights, especially if you plan on selling services. If it is not registered, it might still be considered as passing off but it is more difficult and expensive to prove so in reality it is unlikely they will go after you especially if you don't sell anything and don't use your domain as a trademark.

    It also depends on the company's pockets and how well they protect their IP rights.

    Find the owner of the company and see if they registered any other trademarks, it will give you a sense how serious they are in protecting their IP.
