He is inconsistent in his thinking... Why should it be illegal for institutional racism but not for a owner of a public restaurant? Because one situation is not for profit? It's quite rational, actually. A government shouldn't have racial rules or policies. However, a private individual or group is free to have whatever views they like. While the government shouldn't try to tell people what beliefs to have, it also shouldn't have any racial views or policies. Much like religion or any other set of personal beliefs or views. A government shouldn't have an official religion and should not endorse one, but people should be free to have any religion the choose.

Rand Paul doesn't seem to be a racist but he does use the argument that all racists use and seems to be living in some academic theoretical world.
