The other I thing will say, and then I will let it go, is that insurance companies start (and rightfully so if they are on the hook for claims) dictating what business owners can and cannot do to protect their own property. So they start putting conditions in the insurance policies saying you cannot have firearms on the premises as a condition of coverage, you must not remain on the property if unrest is in process. etc. etc. They dont want to pay out for either your being shot or shooting someone else ore being injured by firebombs etc. All reasonable but just puts down the welcome mat more for the offenders.

    This is what made the Somali pirates rich and made all the ships sitting ducks. The normal mind thinks, "why don't you just fire some warning shots and then blow the fuckers away if they try to come aboard." But their insurance companies invalidate their coverage if any of that happens. They want everyone to just lay low and not have to pay out on any loss of life of crew or liability from some ethiopian pirate.

    Alright enough. But collapse of society has lots of costs and I get pissed.

    Just catching up from yesterday. Y'all probably already know this.

    It turns out that one of the videos they requested is the very same one at the core of the motion for a mistrial (although certainly not the only issue).

    Naturally, prosecutors will want to or did want to argue that if there are any issues related to the flawed video that it did not necessarily impact the outcome of the trial - that it was just one of many things. Then comes a note from the jury asking to see that very same video again which overwhelming confirms that it is definitely pivotal.

    What a mess. Prosecutor playing messy games. Creates mess. Meanwhile, the lefty preps the crowd in Kenosha to blame the white judge who may have laughed at an Archie Bunker or I Love Lucy episode six decades ago. Colonial shiite like that.

  7. Just to put a finer point on this, because the court looks at finer points:

    The defense strongly rejected the prosecutors assertion that "we are not responsible for how it transfered" and that it was just file compression issue.

    They accept the the file compression problem occurred or could have subject to more work but reject the prosecution presenting an image of their trying to do good by handing it over and a glitch set in. They argue that the prosecutor had received firm and solid requests many times to hand over an original copy of the video because they wanted to examine it and have it as part of all other evidence produced at trial as it is presented at trial. They allege that prosecution refused or by their actions did not willingly handed it over but dumped it on to them when they had reached closing arguments. Defense argues that that deprived them of any opportunity to discover any issues with it in a timely manner, which is pretty much what the requirement to hand over copies of all evidence during trial is all about.

    So there is that. More sloppy bad faith actions by the prosecutor, but they were livid about his "poor me, I was good but the dog ate it" attempt. It was a larger issue.

    Anyway. The Judge is hoping there will be acquittals so that he will not be faced with those issues. If not, he will deal with it though.

    Man, that was lame when the prosecution defended themselves by saying it was available because it was on Tucker Carlson. heh.

I think if the real file was eventually provided and defense was given time to review it then the judge might find the prosecution's actions sanctionable but not enough to declare a mistrial which is more appropriate when the trial is concluding and a new peice of evidence is discovered to have not been turned over versus the type of copy that was turned over.

    The are harmless errors which do not affect the outcome but present a cause for sanctioning the office for not responding to requests timely. I think you will find if you deal with a DA's office long enough there is so much going on that these things happen enough that as long as it is rectified somehow it does not lead to a mistrial but simply more time being given for the defense to recall witnesses or make another statement. As long as the judge is lenient thant he defense has no procedural error for appeal strong enough (i.e. the appellate court will say you were given the video, then given a cleaner version of it and extra time to review and recall any witnesses but you chose to simply launch an appeal).

    Errors happen in criminal cases often and as long as judge has given either side the apporpriate time to review and recross or recall witnesses the trial proceeds free from error. We have seen this when either side springs a last minute witness not on the list for example. Both sides are given time to review any testimony and extra time to cross and speak with their clients.

    THe only time it becomes a bigger issue is if the DA buried a piece of evidence totally that could help the defense, then they have broken the law. SImply not providing the clearer original is often a procedural matter than is recitified quickly.

  10. I see a lot of criticism of the white guy judge for not being tech savvy.

    Maybe they should just keep watching MSNBC because they have people who know that shiite can happen in the computer/digital world. You know like when Joy Reid explained how her account had been hacked and someone used it post some really nasty homophobic stuff.

    I also heard Jeffrey Toobin criticizing the judge and asking if you have ever seen a greater idiot. Know but some people did see you playing with your pecker on live tv. So when it comes to idiots he is some "stiff" competition.

    Idiots as far as the eye can see.
