The issue is claim of executive privilege and the time of litigation if Trump were to push this to court. Took the court less than two months to decide the issue to let witnesses speak and documents to be turned over. It went to court BECAUSE it was before the Senate trial. Even then it only took less than 2 months.

It has to be agreed upon and if not, there will be massive litigation especially in the case of trying to call new witnesses. Furthermore, then litigation concerning executive privilege would ensue as well as litigation about whether or not courts have jurisdiction.
