https://www.usatoday.com/in-depth/n...remove-from-office-capitol-pelosi/6579442002/ While it's possible the amendment could be used to sideline Trump, it's unlikely to succeed. Here's how the procedure would work: A majority of Cabinet members would have to sign the letter, but it's unclear whether acting secretaries can vote. Elaine Chao's resignation, effective Jan. 11, and the administration's withdrawal of Chad Wolf's nomination to serve permanently as Homeland Security secretary are added complications. When Grassley and Pelosi receive the letter, Pence would automatically assume the office as acting president until Jan. 20. Trump would not be removed from office, but would have no presidential power. If Pence and Cabinet members wish to challenge Trump, they would have four days to write again to Grassley and Pelosi. During that time, Pence retains power. If they don't, Trump regains presidential power. If they do, the vice president continues as acting president and the decision shifts to Congress, which would have up to 21 days to vote on who should have power. A two-thirds majority would be needed in each chamber:
There's an argument for that, he fucked up in a big way on the 6th. He will be impeached in the House, they'll wait for the senate until after the 20th. Whatever the case, Biden is walking into a shitstorm domestically and foreign policy. Some of it being intentionally left by an angry Trump, much of it still brewing from months and years gone by.
Thereupon Congress shall decide the issue, assembling within forty-eight hours for that purpose if not in session. If the Congress, within twenty-one days after receipt of the latter written declaration, or, if Congress is not in session, within twenty-one days after Congress is required to assemble, determines by two-thirds vote of both Houses that the President is unable to discharge the powers and duties of his office, the Vice President shall continue to discharge the same as Acting President; otherwise, the President shall resume the powers and duties of his office.
I think I am going to be irretrievably radicalized the moment I read that the Mercers were in the Oval Office meeting with President Biden. I know, I know, "going to be?"
You are, quite astonishingly, correct. There is still the argument of is the 25th designed for this type situation, and not just some guy who falls into coma or some other physical incapacitation. 25th ain't happening. Impeachment will.
He would more likely declassify and then launch documents that expose Pelosi, Obama and The Deep State-----and perhaps election fraud.
I don't think it was meant for that, but the text of it allows it imo.I remember David Palmer arguing he wasn't sick when his cabinet voted against him and they bitch slapped him letting him know The 25th doesn't require a medical reason
10 days left to go.. no one is going to invoke the 25th in that Cabinet.. House can vote on impeachment but it wont go anywhere in the Senate. Lets try and be realistic...he is out in 10 days.
He can be tried in the Senate after the 20th. "According to the Constitution, the only penalties allowed to be imposed by the Senate are removal from office and disqualification from holding any federal office in the future." Which is worthwhile. And yes, he is plenty capable of threatening with a nuke. He has a long, long history of a childish fascination with using one, his uncle having been an engineer involved in nuclear science of course. He could give a rats ass about his supporters, how many of them were saying they felt 'physically sick' when he called for the max punishment for those he called to insurrection? Its all about him, there is no limit as the rest of us don't exist really to him. He can go full breakdown, he is in psychotic narcissist mode where nobody sane can get close to him. He would burn down the White House rather than give it over.
