    I'm sure I'm keeping you from your Halloween preparations. Must be great to fit in kids costumes from Walmart off the peg. I guess you get a lot of candy? Do they ever figure out you are an adult?

    If Ingraham (is that her name?) and Yoo are going to make statements such as that on an American News Channel, then the statements ought to have undergone editorial review by the management to make sure there is reliable evidence to back them up. Otherwise these kinds of statements made about private citizens are extremely irresponsible, and can lead to court action. If Ingraham made it very clear she was giving a personal opinion based on nothing but her personal observations then she might lessen the risk, but i doubt she did that. I recently heard an MSNBC commentator take back and apologize for something said on a previous program that could not be backed up. Obviously MSNBC has in place active review by management. I wonder about FOX though. Seems they are irresponsible in their opinion pieces some of the time. If they are careless in regard to public figures, then they will probably get by with whatever they say, but they are taking a big chance with someone like Vindman, who is not a "public figure."

    Larry Flynt, publisher of Hustler Magazine was sued for libel, and other claims, by Jerry Falwell after Flynt published a clever parady of a Campari ad. In the parody, Falwell described his first sexual encounter with women as having sex with his Mother in an Outhouse. Initially, Flynt lost on some claims and prevailed on others. Flynt appealed all the way to the Supreme Court.

    In a famous landmark ruling against the plaintiff, the Supreme Court ruled that because Falwell was a public figure and there could be no question that the Hustler piece was a parody and not actual, Flynt's parody did not constitute libel. Bad taste, and emotional distress brought to the plaintiff was insufficient to constitute libel when the plaintiff is a public figure and no reasonable person would confuse parody with fact.     The comment made by Ingraham re Vindman, however, in all likelihood meets neither of the criteria that got Flynt of the hook. If Vindman can show damages and sues, Fox News could be in Trouble, unless they can show strong evidence to back Ingraham's statement. I would guess Yoo might also be personally liable.
