Paul "The Man" Tudor Jones in the NYT

    Not trying to protect you little cottage industry are you surf?

    If the copyright holder no longer exists then PTJ has little to say in the matter. He consented to the interview, and would have a hard time in court trying to explain the 'harm' the publication would cause him. He would also have the almost impossible task of tracking down the source of the publication and then what court would the action be filed in? The ground has been gone over again and again. The problem becomes interesting if you are selling the content, but 1st Amendment rights and fair use would cover posting without payment for the content.

    I ran across this book review that would seem to agree with me. In "Future of Reputation" by Daniel Solove he describes the problems of privacy in the internet world. From a book review, "...do we have any right to control true information about ourselves? Or influence the way we are portrayed?" Does PTJ have any 'right' to privacy after giving consent to the interview and publication of the interview? Probably not. Check out the book to see other figures that have tried to control, without success, tapes and photos that have appeared on the web.

    To those ET members that disagree, what recourse do you believe PTJ has in the matter?

  2. interesting points, slacker. i guess the person who makes the tape widely/freely available will find out what recourse, if any, PTJ would have. as an example, although not direct, bill gates trademarked or copyrighted the term "book shelf"--- any trademark lawyer would tell you that can't be done--- i have tried to trademark far more obscure things without success--however its amazing what money can do in the court system...... take it as you will.

    Trademark has nothing to do with this issue at all. More FUD, fear, uncertanty, and doubt, from surfer. Your concerns do not stop you from selling a 'new' PTJ tape to anyone having the money does it?

  4. im sorry that you missed the correlation to the issue. allow me to lay it out for you plainly----- money can and does effect the courts on these types of issues. we are not talking about some million dollar a year actor here. capiche?

  5. Even though the market did what it supposed to do I'm a little bit surprised it didn't hit the circuit breakers.

    circuit breaker did come on in Dow Jones 10/24 early in day during European trading hours.

    Whoever took it from the San Diego public library never returned it. When I asked about it in 1995, they told me it had been out for a few years.

  10. You just keep giving and giving and giving, don't you surf? How did I just know that any thread about PTJ would quickly find you and your industrial container of rare copies of PTJ tapes? Tape prices seem to have gone down a tad, haven't they? Perhaps you could plot a chart with the prices for these exceedingly rare copies of the PTJ tape that mysteriously pop out of you VCR from time to time whenever the opportunity presents itself. To see if there is a price trend of sorts...
