    Why would a company official know anything about the mechanics of the trading of their stock?

    The stock being traded is in the secondary market...no longer owned or controlled by company.....delivery or failure of delivery has no effect on company....


    Reason to short KKD.....it sells donuts.....big scam...remember Boston Chicken (Market)? same type of company.....an entire public company built around selling a roasted chicken that every grocery store in America has....

    I call them "swirl companies"....lot of press, lot of hype, swirl it up and take it public.....OSTK is one of those types of companies.....

    OSTK: Buy cheap and sell leftovers....sell below cost, but we will make it up in volume, LOL.....it will never make money....

    Prediction: Patrick Byrne has about a 25% chance of going to jail for a massive fraud....

    Not illegal to "adjust" profit picture....some gray areas...

    But he is manufacturing sales....phony....lying about revenue...

    This is an example of what happens when reporters don't ask the correct questions. Even assuming the judge allows them past the "pleading stage", after potentially massive amounts of discovery is complete (depos, document reviews, etc.), the plaintiffs still may never see a trial because their claims may get tossed by the judge on defendants summary judgment.

    IF the judge allows this to go past the pleadings stage, this thing is still at least 2 years away from trial.

    Law.com reports that all that the attorneys for Overstock.com Inc. want at this point is a trial on the company's libel claims. And a trial it seems they'll get. During 75 minutes of oral arguments Tuesday, San Francisco's 1st District Court of Appeal seemed ready to let the online retailer get a full airing on its claims that a financial analysis company and a hedge fund conspired to put it out of business. "We're at the pleading stage," Justice Maria Rivera told the defendants' lawyers. "It's not time yet to decide all these various levels [of legal issues], because the evidence we have is basically skeletal." Justice Ignazio Ruvolo indicated there was evidence even "at this stage of the proceedings" that could substantiate Overstock.com's claims.

    You're posts are suspiciously selective. They are reminiscent of some paid bashers I helped fuck over. I'm not saying you'd do such an awful thing, though.

    I'll give you another heads up that your career is finished. Rod Young got discovery, and you see how damaging it is. Patrick gets discovery, the dark side will trip all over themselves to settle. Now, some companies tell me they'll take a check and move on. Buttttttttttt, Patrick will be Patrick.

    Folks, you ain't seen nothing yet. I hear reporters are all over the Eagletech case; they are shocked at the ineptitude, criminality is more like it, of the regulatory powers, and that the ensuing stories over the next few weeks will be delightful.

    By the way. 90 days on the OVERSTOCK case. I guess it's just not your day.
