Why would a company official know anything about the mechanics of the trading of their stock? The stock being traded is in the secondary market...no longer owned or controlled by company.....delivery or failure of delivery has no effect on company.... Reason to short KKD.....it sells donuts.....big scam...remember Boston Chicken (Market)? same type of company.....an entire public company built around selling a roasted chicken that every grocery store in America has.... I call them "swirl companies"....lot of press, lot of hype, swirl it up and take it public.....OSTK is one of those types of companies..... This is an example of what happens when reporters don't ask the correct questions. Even assuming the judge allows them past the "pleading stage", after potentially massive amounts of discovery is complete (depos, document reviews, etc.), the plaintiffs still may never see a trial because their claims may get tossed by the judge on defendants summary judgment. IF the judge allows this to go past the pleadings stage, this thing is still at least 2 years away from trial.
