    Biovail is a perenial 'short' fighter. Nothing new here. As all experienced and wise investors know, a company that focuses on litigation rather than their own business is not a good investment.

  3. nobody is argueing the merits of the particular company. It is illegal to manipulate any company. You have to fght the shorts when they manipulate, then they spin, and you go down the tubes.

    If you read the Globe and Mail Piece, it is obvious dozens of like suits are about to hit. dozens, or hundreds of companies like TASR. Tasr made it clear yesterday they are going to fight. This is obviously all coming from the people that left Gradiant, and they know all the companies.

    What happens if SAC unwinds?

    Abelow acknowledged the problem of "naked short selling" is "endemic." He said he personally never engaged in the abusive practice and, as an executive and a director of the corporation, took extensive precautions to try to minimize it. Ultimately, he said it is up to the Securities Exchange Commission and state securities regulators to stop it.

  7. My 20+ years of practicing law tells me both of these cases are losers for the Plaintiffs. That damn, pesky, First Amendment keeps getting in the way. Unless, what was published was untrue.

    Negative reports have always been, are and will always be attacked. Wall Street does not like bears. If you're a chiclet toothed bull, that is another question altogether. You can be a broken clock and you've always got a stand in invite to CNBC and other media outlets to flash that smile and go Ra-Ra-RA.

  9. Funny, my sources tell me just the opposite. That the sources are impeccable. The actual complaint lists a ton of companies that Gradiant is accused of writing about.

    Watch for more suits of this size and scope. Probably same defendants, maybe with new sprinkled in.

    Conspiracy? Never thought that way, but now that it's coming out, it is a conspiracy, should the claims bear out. I have a pdf of the complaint, if anybody's interested. It really is a good read. I wouldn't knowhow to post it, though.

    If the file is not too big, you can attach it by writing a post as you normally do...but then allowing your eyes to fall a bit lower than the window in which you type. There you will see a small little white rectangular window and a grey button marked BROWSE. click it and find the file on your computer's HDD and then click ok. Then click submit reply.
