OMG!! The plot thickens... Does your mom remember signing up for the card? Actually signing on the application form that applies for the card? It looks like they strongly persuaded her to apply for a Walmart credit card (they push a lot in the store because all the store employees get financial incentives whenever a customer signs up and gets approved for the credit card with them) and then just instantly approved her which would not be surprising as your mom must have really good credit history. Store credit cards get instantly approved all the time and they can be used right away to make purchases with that discount that they were offering to your mom. No need for activation whatsoever and they will tell you the physical card will arrive later in like 2-4 weeks or something like that. That way the store employees get the bonus and your mom gets the discount; everybody wins. But the bottom line is did your mom actually apply for the credit card? Did she give consent? Did she actually sign on the application form ti authorize the credit check and the application? If she didn't and they can't produce a signed application form by your mom, then they did it without her authorization and that's still fraud.
My brother said there was no mention of a credit card. They asked her if she wanted to save money and just took her personal details. But I wasn't there so I cannot guarantee his testimony.
If she didn't sign a document, they opened a credit account in her name without her permission. That's bugger-all illegal. Wells Fargo got busted big time for that last year. It was so bad the CEO was forced to resign. She says she signed a form. It's just that she was never aware of applying for a credit card nor was my brother who was beside her at the time. She was under the impression she was saving 15% on some deal. Maybe the employee wasn't being clear enough and took advantage of her english. But everything is uncertain since I wasn't there to bear witness. She realizes she can't dispute it anymore. And only wants the card cancelled.
But your mom must've seen that they didn't use her regular credit cards or any other method of payments to pay for the purchase? She knows she's only getting 15% discount not getting the entire purchase for free. And if she didn't think she is getting a new credit card then she would've known that she would have to use her regular credit cards or cash or other methods of payments to pay for her purchase or did that Walmart cashier tell her that everything is going to be put on her newly applied credit card and she can just walk away? If that's the case, then your mom would've known that she applied for a new credit card or new something. How could your mom walk away from the store not paying for anything and still thought it was ok? And with your brother too? LOL This is the part that neither you nor I just didn't and still don't understand. Oh well that store cashier got some bonus and your mom would have to pay for the purchases on that new credit card now before she can get it cancelled. Next time I suggest you go with your mom when she goes shopping instead of your brother.
To be frank, both my mom and bro can be numbskulls. If I was there this never would had happened. But it's not really a huge deal. She still got a gift card for the same price.
