And, why would a merger agreement go to a jury trial? Come on. Making Musk buy Twitter at $54 is most likely impossible because he probably doesn’t have access to the funding anymore and a lower price puts the board at risk to shareholders. There’s already lawsuits from shareholders that are meritorious. When the judge, not a jury, peels back the onion it’s going to be Musk that stinks, is my guess and he will be on the hook for the $1 billion in the end. At the end of the day I think my prediction that Musk will sink two companies with this Twitter fiasco will hold up well. Heres a good thread to sober you all up:
Some truthiness contained therein, especially in regard to selling Tesla shares or using them as collateral on other financing. But he already has 19 other investors in with him already. Some biggies too. Larry Elison, Sequoia Capital etc. Although it would dilute his position, I don't see why he could not just go bigger with his current investors or add more in if he wanted to make it happen. Not sure he does or has accepted that yet but I am saying if he does or is mandated to do so.
I was actually thinking Musk may end out trying to claim non compos mentis but you bring up the point about other investors and that kind of undermines that. But the reason why I bring up the financing is because the Twitter deal is all financed through his personal holdings and there is a backstop that if Tesla falls below a certain level it will force a sale of the collateral stock to pay the loan. As this gets litigated through I would expect Tesla to take a pounding and the finances of the deal to turn to shit. Also, I’d like to note Musk may be ultimately on the hook for $2 billion. There is some separate provision for another billion I can’t recall right now but it will probably turn up at a later date.

I call em like I see em down here in politics, and at least imo, Tree's opinion/narrative/prognostication on many things is spot on. I don't agree with his, and pretty much everyone else down here, when it comes to this financial support, billions monthly, for the Ukraine into infinity, because that's what it's going to be until Putin dies, but other than that, Tree has a pretty good grip on things. His two posts above were quite informed. Ocho may lean a little left, but he's not an extremist and always worth the read, whether I agree or not.
