What you dont understand is that the law may be declared consitutional but its actual implementation will be decapitated. The ruling did the following: 1. Sought to preserve the Court's reputation as an impartial institution (LOL) 2. Rejected the reasoning of commerce clause as justification 3. Substituted it as a TAX which is not good for an election year issue 4. Gutted the actual implementation of it.
