“Mueller was appointed as a Special Counsel by Rod Rosenstein in May 2017 pursuant to Rosenstein’s authority as Acting Attorney General. In the appointment order, Rosenstein states that Mueller is subject to the regulations governing special counsels. One of those regulations, 28 CFR §600.7 (a), specifies that the special counsel must “comply with the rules, regulations, procedures, practices and policies of the Department of Justice.” Therefore, Mueller must comply with the policies of the Justice Department – and the policy of the department according to the opinions issued in 1973 and 2000 is that a sitting president cannot be criminally indicted or prosecuted.” https://www.heritage.org/crime-and-...ueller-indicting-trump-wont-happen-even-if-he
Which means that Mueller will be following the DOJ policy practice that he can’t indict Trump as a sitting President. He can write a report to Congress.
As I recall, the last “statement” from Mueller about Trump was in March when he told Trump’s lawyers that the President was not a “target” in his investigation (whatever that means literally or figuratively).
Rudi also said this: Rudy Giuliani warns Mueller doesn’t seem to realize ‘they’re interfering with things that are much bigger than them’ In a Wednesday interview with Fox News host Laura Ingram, President Donald Trump’s attorney Rudy Giuliani claimed that special counsel Robert Mueller doesn’t seem to know who he’s dealing with. The former New York mayor first explained that the investigation into Trump should be ended immediately because it “is not good for the American people,” though he didn’t explain why. He said that he’s working to try and end the investigation. “The special counsel’s office doesn’t seem to have that understanding they’re interfering with things that are much bigger than them, or us,” he continued. Though, again, he didn’t explain what those “much bigger” things are. He then revealed that he’s only met with the Mueller team once and has sent them five letters, to which they’ve had no response. Throughout the interview, Giuliani made several comparisons to Trump and former President Bill Clinton’s arguments against testifying or being subpoenaed. He also said that he sent Mueller a letter demanding the “Hillary Clinton treatment,” which he said would have given the legal team the full report two weeks in advance of the announcement.
