Wow....i feel bad for you if the State every hurts you because according to you the judges should shoudl side with the state automatically and you should be denied justice. Google how judges get their job... Google who awarded the money in the cases we are talking about... Sorry my friend... you are way out of your league claiming judges work for the state and should decide cases in favor of the state regardless of the facts. Tell me which judge awarded George FLoyd millions of dollars....? Whihc judge awarded the guy $750,000 for wrongful imprisonment? Try doing some research before citing things as facts.
I'm not saying they should side with the state. I'm saying they aren't likely to punish the state with punitive measures. Their decisions should be fair on a case by case basis. It's up to the voters to change the system.
Take some time and google punitive damages and who awards them... we will wait for you to catch up. Also who awarded the money in the George Floyd case and the guy imprisoned who got $750,000.
I also generally disagree with the idea of "making an example" of somebody with excessive punishments/fines. To me that is the antithesis of the 8th Amendment.
You're right that it happens more than I realized. I disagree with it. I also disagree with George Floyd's family getting $27million. It's just too much money in my opinion. Chauvin should go to prison for a long time. He murdered Floyd. However, justice isn't supposed to be about hitting the lottery.
You know what justice is? Cops stop killing people. When a city has to pay a settlement, the police, mayor and governor should wake the fuck up and do smething about it. They don't so the people should feel it in taxes because they are electing the same fucktards who do nothing about it. Justice is supposed to be about cops following the law and not violating people's civil and constitutional rights. It has been 60 years since police beat up minorities, hosed them down and arrested them if they went to the wrong toilet. A lot has changed but why are cops still abusing their powers? Where is the justice you claim? The civil court is created since the times of the Constitution as a place for civil judgments and is completely legal. These payouts are SETTLEMENTS because the city knows they fucked up and would pay 3x the amount in court mostly by a JURY (seriously do some homework on civil trials). If the State keeps fucking up then the State should pay. I dont care if Floyd's family does not deserve millions, the State should be punished because this is not the first time things like this happened. Paying millions is how you wake them the fuck up and make a change.
Also, with all due respect, your social studies teachers failed you when they covered separation of powers under the Constitution and its applications in States also. Judges work for the State? please don't say that again. I know many people here are not up on legal matters but seriously. Do Supreme Court justices work for Trump? I forget.... Google District Attorney.....you might be surprised who that is....
Also in many cases, cities settle and admit no wrongdoing.... then the shit keeps happening. If the people are not going to elect people to fix the problem, then they shoudl see their city pay until they do..
Fortunately @kmgilroy89 , not many people, jurors, judges, prosecutors, etc. think like you. 60 million Frenchmen can't be wrong. I recommend you do some deep research.
You're saying judges aren't government employees? Who pays their salary? They're a separate branch of government. The comparison in the private sector would be suing a company, because of what one employee did. Now, how liable should a company be for one bad employee? You do have to prove negligence on the company.
