    I am defending neither the cop nor the driver. I am placing fault on both parties.

    The driver should have just pulled over. The cop should have known the law and know that people in general will shift over to the left when they see the flashing lights on the side of the road, especially at night.

    The LEO can get out of his vehicle after the driver pulls over and inform them that it is not a safe place to perform the whole shebang, and move to a safer place.

    Let me ask any reader this...When you see an emergency vehicle pulled over on the side of the road...do YOU slow down or move to the next left lane? Of course you do. It is common sense.

    The woman not pulling over is her fault. The cop performing a pit is also at fault. There was no need for it.

  2. If the cop performing the pit is at fault then that is the end of the discussion. Cops are not allowed to be judge jury and executioner in simple traffic violations. If the move was wrong on the part of the cop, then he broke the law he is sworn to uphold.

    Just because that is what YOU would do does not mean she was breaking the law requiring her car to be rammed and overturned.

    Let's say you throw a piece of paper on the floor and and a cop is walking by and he yells at you to pick it up really loudly. You start getting up from bench slowly and hesitate and he takes his baton and slams it on your forearm breaking your arm and says "You pick up the trash when I tell you to immediately!"

    Your arm is broken for 8 weeks in a cast. Does the punishment fit the crime?

    There was no need for it but you are not at fault for your actions and warranted that cop reactions.

    Cops are subject to the law just as everyone else is and a car slowing down and putting on hazards is a justification for a ram the same as someone fleeing the cops at high speed. Just like if you call me an ass and I crack your skull with a baseball bat I am committing a crime. You are not at fault for calling me an ass.

    To use that maneuver for a traffic stop is just stupid. You're going to risk injuring/killing someone for speeding...on divided highway?

    The driver is wrong
    With lights flashing a driver does not have the authority to determine the terms of the stop
    As an office making the stop, when the driver continues to drive, what is the reason, Is it to find a spot that they can run from , is it to get time to find a hidden gun?
    If you do pull over and the officer thinks it is unsafe he will give instructions on what to do, sometimes via PA speaker

    The rules do give a driver some option to find a more comfortable place to pull over. This driver went 2 minutes and still didn't stop, almost 2 miles
