Kroger reports tomorrow. It's at $43.50.
I think it might take a hit this time around.... so if anyone owns it, the Dec $42 puts are pretty cheap as a hedge just in case.

Lawmakers call on US regulator to thwart Kroger-Albertsons deal

NEW YORK, Dec 12 (Reuters) - Six U.S. lawmakers wrote to the Federal Trade Commission (FTC) on Monday expressing their opposition to the proposed $24.6-billion acquisition of grocery chain operator Albertsons by peer Kroger Co (KR.N), according to a letter reviewed by Reuters.

Kroger and Albertsons have said they expect to complete their merger by early 2024, once the FTC completes its antitrust review.

Senators Elizabeth Warren, Mazie Hirono, Bernie Sanders and Cory Booker and representatives Summer Lee and Alexandria Ocasio-Cortez said in the letter that Kroger's proposal to divest 413 stores to C&S Wholesale Grocers would not address harms to consumers, workers, and the grocery industry if the merger is allowed.

The lawmakers are arguing that store divestitures as a remedy to mega mergers often fail to maintain competitive conditions, because companies have an incentive to ensure that the businesses they spin off do not succeed.

C&S, which secured financial backing from SoftBank Group Corp (9984.T) for its deal with Kroger, operates primarily as a supplier rather than a grocery-store operator. It currently has around two dozen stores under the Grand Union and Piggly Wiggly brands.

“Kroger’s merger with Albertsons will mean workers gain from $1 billion in higher wages, expanded benefits, long-term job security, and a strong unionized workforce. The merger will also mean lower prices and more choices for fresh food for customers and more investments in our communities," a Kroger spokesperson said in a statement.

Other lawmakers, including congressmen Greg Landsman, Brian Fitzpatrick and Josh Gottheimer have sent letters to the FTC in support of the deal.

“Albertsons merging with Kroger will expand competition, lower prices, protect union jobs, and enhance customers’ shopping experience,” a representative for Albertsons said in a statement.

The only parties that would benefit if the deal is blocked would be Amazon, Walmart and other large, non-union retailers, whereas a combined Kroger and Albertsons would ensure that neighborhood supermarkets can better compete against large retailers, Albertsons argued.

    The FTC declined to comment.

Kroger has said that it will not close any stores, distribution centers or manufacturing facilities or lay off any frontline associates as a result of the merger.

Krogers does more to feed needy people than any operation out there. They are all about giving back to the communities they serve. AOC's an idiot. Wouldn't it be awesome if we found out a few of them or their significant others shorted the stock? I'm surprised Pelosi didn't sign that letter.

I wonder how much Walmart donates to each of their respective PAC's. :wtf:

I mean.... even I have a hard time understanding all the intricacies of this merger and the associated divestitures. No way these people have the time to dig into this. That's lobbyists juicing their staffs with free lunches and anything else they can get away with. Like AOC could possibly understand all that's involved here. I'm not saying they're stupid people, far from it for the most part, but this letter reeks of special interest groups. But hey... that's America.

yeah. Uh huh. There’s no revenue synergies only cost ones: purchasing power or reduction of footprint.

    Well.... maybe.

But shouldn't they just let the FTC do their job? I mean that's what they get paid for. The best and brightest right? That's like the board of directors at Notre Dame telling the coaching staff what offense to run that weekend.
