Which is EXACTLY what state reps and sheriffs should be doing. The taxpayers in state are covering more than half the costs per student at this public university. The state representative should be demanding that the university does not have put on displays at public events which offend the taxpayers. The Sheriff should be asking for the university not to allow students to offend large portions of the fans simply from a keeping of the peace perspective. Do you really want the alumni to charge down onto the field after chanting "Stand up, fat pigs" (which is what happened at an HCBU in our state and ECU where the "kneeling will not be tolerated"). Better that the university president take proper measures to get ahead of the trouble.
You do not have first amendment rights when participating as an authorized member of a university organization at a public function. If you do not follow their rules and guidelines then you will be kicked out of the squad or team.
You are incorrect. There is a big line between being expelled from the school for not participating and being removed as a member of a squad/team representing the school at a public function. I can only states pass laws spelling out very clearly that students will be dismissed from squads or teams at state universities if they kneel for the anthem at public functions.
Afraid not. Every court case regarding athletes or cheerleaders at universities has determined they can be dismissed for any reason. This has been held up for many decades. The ECU marching band members who were dismissed from the squad got laughed out of court when they brought a case claiming "first amendment rights".
Very well --- the cite for me the cases where a university student successfully used "first amendment" rights in a court case to avoid from being dismissed from a public university team or squad for actions the student did during a public event. Please find an example.
You first... find me a case where a university student successfully used "first amendment" rights in a court case to avoid from being dismissed from a public university team or squad for actions the student did during a public event. Please find an example. You can go google the ECU marching band to look at all the information. Even the ACLU refused to help them saying they had no case. ECU took a real hit when these absurd students did not stand for the national anthem. The radio stations in the state refused to carry their games, nearly all the advertisers / sponsors dropped the university, and people from across the entire state demanded action be taken. Quite rightly the students that refused to adhere to the rules were dismissed from the marching band, and then they carried on with public ruining their uniform attire in protest, and claimed they would sue, etc. etc. Every legal foundation told them they had no case.
