    You keep saying "right." When a health inspector closes a restaurant, does that mean he has violated the rights of all those employees? Is it his job to ensure there are employment opportunities out there for those employees?

    This has been addressed ad nuseum. The Supreme Court (not just the left but also the right has consistently said that these rights aren't unlimited in scope. They have said this since the beginning of America. It's clear that there is no violation of constitutional rights. No one has brought it to the Supreme Court nor has it been an issue from any meaningful person.

    What about the "Right to Life." You coughing all over me violates my right to life.

    But here is the real issue:
    When you talk about "Rights" you obfuscate the honest discussion on what we are doing. No one is closing the restaurants in order to punish its citizens and actively deny them their "rights to work." Freedom of Assembly and Freedom of Religion can be limited by the government.

  2. Due Process involves the rationale and application of the shut down. The President, CDC, Surgeon General and the Coronoa Virus Task Force declared a State of Emergency and asked for Social Distancing and Lockdowns/Stay at Home Orders.

    Therefore a State telling people to not gather in groups which also would include religious gatherings is reasonable and with the power of the State. That is the due process.

    Pretty technincal and direct.

  3. The President, CDC, Surgeon General and the Corona Virus Task Force declared a national state of emergency.

    SC has upheld limitations of rights for less.

    Now in the case of Governors many of them may be exceeding their powers and that can be defeated (i.e. one state saying no landscapers working while 8 surrounding states allow it with no issue, then the one state's decree is random and unreasonable and should be eliminated).

    Autopsy: Santa Clara patient died of COVID-19 on Feb. 6 — 23 days before 1st U.S. death declared

    Health officials said Tuesday that new autopsy results show a patient in Santa Clara, Calif., died of COVID-19 on Feb. 6, several weeks before the United States declared its first novel coronavirus death.

    The finding suggests that the virus was circulating in the San Francisco Bay Area earlier than previously thought.

    The U.S. Centers for Disease Control and Prevention reported the first fatality due to coronavirus complications in the United States on Feb. 28. The patient was a resident of Kirkland, Wash.

    Now, the Santa Clara County Public Health Department has identified two individuals who died of COVID-19 at home on Feb. 6 and Feb. 17. The health department said samples were sent to the CDC and the results were shared Tuesday.

    In Santa Clara County, Dr. Cody said that the picture of the spread was becoming clearer but that there were still gaps.

    “We had so few pixels you could hardly pick out the image,” she said. “Suddenly we have many pixels that all of sudden that we didn’t even realize that we were looking for.”

    But, she added, “I can’t put the story together yet.”

    On March 16, Santa Clara County was among the first counties in the nation to announce stay-at-home orders. “Clearly in retrospect that was a good decision,” Dr. Cody said. “Now we see there was even more transmission than we recognized.”

    Although California was an early state to report that individuals were carrying the virus, it has had one-tenth the number of deaths as New York State, the hardest-hit place in America. Officials believe that the early imposition of stay-at-home orders and the state’s lower population density are among factors that have helped California avoid the worst so far.

    Stop. Just stop. I already said that if a place of business violates established laws, then it gives up its right to run a business. Just like in El Ocho's examples when someone breaks the law by shooting someone, they don't get the right to own a gun anymore. This is obvious.

    Again, you're missing the one critical factor that due process wasn't given to restrict these rights. It was just dictated to the people from the government. That isn't how any of this works. And if you believe it is, you really need to read your Constitutional Law.

    This is just dumb. First, people aren't "coughing all over each other". Second, it doesn't kill you. An infected person intentionally infecting others can be held liable and there are court cases where this has happened. But people blow smoke in my face, and cigarette smoke is known to kill, but that hasn't led to locking us all up. All it led to was the establishment of a non-smoking section!

    It doesn't matter why they are closing all of the places of business. But they are doing so and denying people the ability to earn a living. Period, end of story. Wall paper it however you wish. You said no one is taking away the right to work. But they are.

    Ah, so in your world, for whatever reason, as long as the State declares an emergency they can suspend the Constitution. This satisfies your definition of "due process". Holy Christ, I had no idea there were so many people on this forum willing to surrender all of their rights so easily. I'm genuinely stunned.
