Charge has been moved up to second degree..........and I am back to say it was a smart move just as I said I would above. My post was to challenge the assertion that it was a smart move to charge him at a lower level just to eliminate the possibility that he can skate. No. Charge at the higher level, convict at that level, let the jury convict at a lower level which is allowed under Minn law, or let the defendant try to plead down to 3rd degree if the prosecutors run into trouble with the jury and the defense team that they think they cannot handle. I don't have an opinion on the other officers. The prosecutors and the lawyers can work that out based on the involvement of each officer. I have heard the mob and the family call for first degree charges against all of the men, which of course is understandable emotionally- but bullshit legally.
