My understanding is that when a picture does not have a copyright watermark it is generally considered to be in the public domain (i.e. not copyrighted) and need not be licensed or have permission sought. If my understanding is incorrect, let me know. Citing your source would be helpful.
Mr Atticus is right about this. HoCo apparently copied the image onto his own commercial site's webserver. I have been told by many site owners that they prefer that I copy the image and serve it from my site rather than consume their bandwidth. None asked for attribution. If they were in the business of creating images, they request that I license it. If the image was incidental to their business, I was permitted to use it. I was never denied. After a year or so of always asking permission I have become lax. I will not use watermarked images, but I have not been asking permission every time. I cannot recall the provenance of the image I just posted, so I cannot state categorically that I have permission to serve it from my web site. Thanks for the heads-up. I shall research this further to make sure I am clean.
Yes, many webmasters view taking their images as a lesser evil than horking their bandwidth. "Watermarked" is irrelevant -- it isn't required for copyright. I applaud your effort to cross the t's and dot the i's. It's rare and laudable.
