1. My understanding is that when a picture does not have a copyright watermark it is generally considered to be in the public domain (i.e. not copyrighted) and need not be licensed or have permission sought.

If my understanding is incorrect, let me know. Citing your source would be helpful.

  2. Mr Atticus is right about this. HoCo apparently copied the image onto his own commercial site's webserver. Appropriate, instead, would have been to link to the image on its original site.

Taking images from third-parties. The simple rule is, "Don't steal someone else's images." The moment an original image (or string of text) is fixed on a hard drive for the first time, it is protected by copyright... In most cases, it is unlikely that the incorporation of an image into a commercial web-site would be considered a fair use.

  3. I have been told by many site owners that they prefer that I copy the image and serve it from my site rather than consume their bandwidth. None asked for attribution. If they were in the business of creating images, they request that I license it. If the image was incidental to their business, I was permitted to use it. I was never denied. After a year or so of always asking permission I have become lax. I will not use watermarked images, but I have not been asking permission every time. I cannot recall the provenance of the image I just posted, so I cannot state categorically that I have permission to serve it from my web site.

Thanks for the heads-up. I shall research this further to make sure I am clean.

  4. Yes, many webmasters view taking their images as a lesser evil than horking their bandwidth.

"Watermarked" is irrelevant -- it isn't required for copyright.

I applaud your effort to cross the t's and dot the i's. It's rare and laudable.

  5. The watermark is under the penny to the right on the image. You are my source.

  6. I think Butler will make the Finals but Connecticut or Kentucky is surging and might be too deep for Butler to beat out.

(sorry, thought we were posting random useless off-topic info)

  8. haha, yes, but maybe you missed the pages upon pages of HoCo lambasting Maverick for posting a cartoon of the three wise men. Then he posts a watermarked pic and debates the legitimacy.
