What? The employee HAS to give 3-months notice to quit? Even if his boss and company become insulting, abusive, unbearable?
Actually I had to google the issue to double check... if the boss or company becomes abusive, the situation is special, I don't know he's supposed to go back to work and what happens if he doesn't, but the employee will most likely go to the labour court and get quite a bit of money out of it. A couple of years ago in Lyon, the labour court cases were ruled 80% in favour of the employees if I recall properly, and employees sending their boss to the labour court are plaguing the french labour market. Sometimes even nannies sue their employer ?!? If an employee becomes abusive or insulting or stops coming to work, one still be very careful over the form to fire him, or the employer could well be fined in labour court. Besides in the case of no particular beef between the employee and the company, like when the employee wants to move to a better paying job or simply stop working, the duration of the advance notice depends on his line of work and his position. Most of the time for low level employees it appears to be 1 month and 3 months for executives. In Investment Banking, as previously mentionned, if the employee gets a better job offer at another bank, he will give his advance notice 3 months ahead but will be asked to leave the office about immediately, before enjoying 3 month full paid vacation by the former employer, not yet allowed to work for his new company. Happenned to a couple of friends of mine who enjoyed it quite a bit.
