House to vote on whether to consider articles of impeachment for Trump

Discussion in 'Politics' started by Banjo, Jul 17, 2019.

  1. At the federal level, the impeachment process is a three-step procedure.

    • First, the Congress investigates. This investigation typically begins in the House Judiciary Committee, but may begin elsewhere. For example, the Nixon impeachment inquiry began in the Senate Judiciary Committee. The facts that led to impeachment of Bill Clinton were first discovered in the course of an investigation by Independent Counsel Kenneth Starr.
    • Second, the House of Representatives must pass, by a simple majority of those present and voting, articles of impeachment, which constitute the formal allegation or allegations. Upon passage, the defendant has been "impeached".

No--it comes from The House which may then authorize a committee to investigate, not the other way around. Jerrold Nonads is going down a path that will open up both sides to take up impeachment willy nilly any time they want. Direction to the committee must come from the full House. The committee still hasn’t been authorized or instructed by the House to conduct a formal impeachment inquiry. Pay attention

  3. Individual Members of the House can introduce impeachment resolutions like ordinary bills, or the House could initiate proceedings by passing a resolution authorizing an inquiry

First, an impeachment resolution must be introduced by a member of the House of Representatives.

Any individual Representative can put forth a motion to consider impeachment to be voted on by the House.

A complaint requesting an impeachment investigation of that official is lodged with the House of Representatives. That request may either be general in its scope or it may delineate specific offenses; it may be requested in a petition filed by individual citizens or on the request of a single Representative, a group of Representatives, or the President.

“The request is referred to the House Judiciary Committee which forwards it to the Subcommittee on the Constitution. The Subcommittee then investigates the complaints and, if there is merit to the charges, Articles of Impeachment describing the specific offense(s) are prepared. Those Articles are forwarded to the full Judiciary Committee for a vote. If approved, the Articles are sent to the full House for a vote.

So if a crazy Dem wants to put forth a complaint for impeachment to be referred to the Judiciary Committee they can. It is up to the leadership to decide if they want to take the impeachment complaint or bill and refer it to the committee. But an individual can start the process and if Nancy Pelosi wants to refer it to the Judiciary Committee she is free to do so or refuse. She has already made it clear she has no intention of moving it along.

What you know about the Constitution couldn't fill a sperm.

It's amazing how little you know about how procedures work. The House must first authorize the House Judiciary Committee to open an investigation. This has not been done and so what Nonads is doing is simply for show as nothing legally can come of it. This is why Pelosi continues to get asked about impeachment and whether she thinks it should go forward. The House would need to authorize and then direct the committee and set standards for the committee and investigation. By the way, in The Constitution, there is no House Judiciary Committee, but there is a House which is responsible for bringing impeachment by majority vote .

No one said that an individual could not start the process. But to start an investigation by yourself in committee without House authorization like Jerry Nonads is doing? Nope

  6. DOJ obstructs House impeachment inquiry – asks federal court to block release of Mueller Grand Jury files: report

In a stunning move Attorney General Bill Barr’s Dept of Justice late Friday afternoon filed a 40-page brief with a federal court, declaring the House Judiciary Committee’s impeachment inquiry is not an impeachment inquiry, in an attempt to block release of files related to the Mueller probe.

It appears to be an unprecedented act, in which the top law enforcement agency is attempting to block Congress from carrying out its constitutional duties.

The DOJ is attempting to block the release of Special Counsel Robert Mueller’s grand jury files, according to Politico. House Democrats have frequently said they cannot make an impeachment decision without the underlying materials from Mueller’s exhaustive investigation.

  7. Two years and 40 million dollars of Mueller investigation and now the house is trying to get the grand jury files to re-do the investigation.

    Get a job, clowns.

Good luck in federal court with that request.

And Barr is absolutely correct in his actions. He does things lawfully not illegally like Jerrold Nonads. ---The House has not authorized an impeachment inquiry, thus there is no impeachment inquiry to deliver files or documents to.

It was my understanding that Grand Jury files are sealed by law.

It's a moot point at this juncture. There is no legal basis for an impeachment inquiry, thus one does not exist.
