"Advertising" is defined by how widely dispersed the solicitation. The regulations require that ONLY eligible investors receive the advertisement. Burden of proof is on the advertiser. Go carefully on this one. It's a biggie with the regulators.
go easy with advertising since you cant "mass market". all potential recipients of advertising must be accredited investors so must be qualified first. Pete
DO THE INVESTORS SIGN A CONTRACT OR SOMETHING LIKE THAT STATING THAT THEY WILL LEAVE THEIR MONEY IN THE FUND FOR A CERTAIN LENGTH OF TIME ? YEAR ? 2 YEARS ? 5 YEARS ???? THANX
you can determine that in the docs. usually there is some time that you can say that there is a "hold" on the withdrawl of funds. pretty easy to do and most hedge fund investors know that they are not meant to "buy and sell" in and out of hedge funds - they are giving you the money to go to work with... THANKS PETE ! DO YOU RUN A FUND ? IF SO COULD YOU POST YOUR WEBSITE IF YOU HAVE ONE SO I CAN TAKE A LOOK AT IT ??? THANX
it's called a lock up period. the lock up period can be any length the fund management determines but it is generally one year. furthermore, disbursement amounts are controlled by the agreement and normally need to 25k and over.------------------------ surfer
