HA, women sues AAPL for $1M over $200 price cut....

    I cannot believe that a lawyer actually took this case, it seems in todays age you can sue just about anyone or anything, amazing. If I were her lawyer I would have laughed and said do you really think your going to be rewarded $1M in damages for such a pathetic case....Quite pathetic that something like this would even make the news.

    Incensed Over iPhone's $200 Price Cut, Woman Sues Apple for $1M

    SAN JOSE, Calif. (AP) -- A New York woman is so angry at Apple Inc. for lopping $200 off the price of the iPhone that she's filed a lawsuit seeking $1 million in damages.

    Dongmei Li of Queens, N.Y., claimed the company violated price discrimination laws when it slashed the price of the 8-gigabyte iPhone by a third, from $599 to $399, within two months of the gadget's June debut.

    Apple lowered the iPhone's price on Sept. 5 and also said it would stop selling the $499 4-gigabyte model. Hundreds of early customers who paid full price didn't expect a reduction so soon and complained.

    Apple issued an apology the next day. Under its return policy, Apple refunded the $200 difference for those who bought the phone within 14 days of the reduction. And in a move to make peace with those who purchased the higher-priced phone before that period, the company offered a $100 credit at Apple stores.

    According to Li's lawsuit, filed on Sept. 24 in the U.S. District Court, Eastern District of New York, the price reduction injured early purchasers like herself because they cannot resell the product for the same profit as those who bought the cell phone following the price cut.

    Li purchased a 4GB iPhone for $499 and alleged that owners of the 4GB model were given less favorable terms than those who bought the 8GB model at the premium price, according to the lawsuit.

    Apple spokeswoman Susan Lundgren declined to comment, citing the company's policy to not discuss pending litigation.

    The lawsuit also named AT&T Inc., the exclusive carrier in the U.S. for the iPhone, and alleged the two companies' required two-year service contract for the iPhone constituted unfair business practices.

    Mark Siegel, an AT&T spokesman, declined to comment, saying he had not yet seen the lawsuit.

    Basically a lawyer sees Apple as a defendent and the cause of action is not silly given the fact that Apple chose to give relief to only a select group of buyers of the iPhone based on a random time period and screw over all the others that had bought the phone on the first day. So Apple did make a big boo boo and the best thing they could do is simply refund the differences to ALL since they profited from it.

    Does it rise to the level of a $1 million lawsuit? Of course not. But remember that anyone can file a lawsuit, it costs so little to file the paperwork and a lawyer will do it on contingency looking for a payout. So filing is nothing and just because someone files does not mean they win. Apple's costs to defend a suit like this and the countless others (read its annual report) is a drop in the bucket and it will get nowhere.

    Lawyers can sue anyone and ask for anything but liklihood of success for most of these is so small. BUT most people said that about a woman suing McDonald's over hot coffee put between her legs. I bet no one called that lawyer stupid after he got 33% cut of those millions lol. So I guess we truly never know who has a chance or not, that is why so many sue cause it is akin to a lottery. A lawyer can do 10 of these suits and only has to hit one for a payday. IN defense, most lawyes in the profession are not trial or plaintiff lawyers so it is not representative of the whole profession :)

  8. Apple cannot really settle easily because then every one of those thousands and thousands of people will then step forward. Apple might agree to give all buyers the $200 difference back and that is all they are realy entitled to. Should be interesting.
