    Republicans make it very hard for them though.

    The hypocrite republican governor sued for and got millions for a tree falling on him than later supported laws that limit pain and suffering compensation to 250,000.

    I have never seen a bigger group of hypocrites as republicans.

  3. Many products and services have terms of service that include arbitration provisions that explicitly prohibit the customer from seeking class action status on lawsuits. Many employment contracts are that way as well. For many years, appellate judges would routinely throw out large jury awards. On top of this, jury award limits were codified into law. These laws encourage unfair trade practices against smaller businesses and questionable businesses practices towards customers because their risk is defined. For example, if 5% of customers are expected to complain, .1% will actually sue us, 90% of those will settle for a nominal value, and the balance will go to trial, 30%+ trials may be won by the corporation outright, and the trials that are lost by the corporation, even at the full legal maximum award, plus court costs, will only amount to a trivial amount on a per customer basis, making most corporate scams profitable. In other words, our legislative and court system effectively encourages corporate malfeasance to the detriment of consumers, regardless how they vote.

    Consumer protection and individual rights while on the job have been overwritten by civil laws in favor of large corporations, effectively bypassing individual Constitutional protections for most of one’s waking hours.

    It is good to be a large corporation, insurance company, or otherwise. After all, our government is now of the corporation, by the corporation, and for the corporation.

    Remember, it is best to not complain so you will not be labelled as a malcontent, as there is a hand, not quite invisible, that is always hovering over the “Cancel” button.

  4. There is no clause for a tree falling on you though...this pain and suffering are not part of what you are talking about because that is tort law and you are referring to a contractual clause in an agreement between parties.

    The governor got millions in his lawsuit and then decided fuck everyone who comes after him and voted to limit the award of such damages in the future..

    Money for me but not for thee....

  6. On a practical level, if a prospective employee refuses to sign away their rights, they don’t get hired, even in high demand positions. The vast majority of job seekers are compliant and employers can use the “We have to treat everybody equal” line against objections.

    I personally have objected to multiple provisions in employment agreements and terms of service for certain purchases. The initial response is almost always along the lines of “Oh, that’s just lawyer stuff”. “We don’t actually expect (Whatever) to happen”.

    There seems to be a systemic defect or inefficiency that allows or condones individual rights to be infringed upon, such as search and seizure, reduced employee, customers, or a member of the public’s compensation to arbitrarily low amounts, or creating different threshold levels and or definitions concerning liability for wrongful or neglectful acts of a employer, manufacturer, or vendor.

    We need justice reform and a potentially good way to start is for voters to get even more involved in politics, I mean sincerely involved in politics, throw out all incumbents, and bring in those who receive the least corporate political contributions and the least media coverage as a primary criterion.

    The protests seen after the Covid shutdowns suggests people can get fired up if they have extra time on their hands. Perhaps next economic downturn?
